said hig~ay open to traffic at all times. and

directed on behalf of the ~/Village to enter into agreements with the Director of
Transportation. necessary to complete the planning and construction of this improvement.

I, (a) That all existinq streetandpUbHc way iiqht'"--of-way within the tiItw/
Villaqe which is necessary for the aforesaid improvement, shall be made
available therefor.
(b) That the~/Municipality will acquire any additional riqht-of-way
required for the construction of the aforesaid improvement.
(c) That arranqements have been or will be made with and aqreements obtained
from all public utility companies Whose lines or structures will be affected
by the said improvement and said companies have aqreed to make any and all
necessary plant removals or rearranqements in such a manner as to be clear
of any construction called for by the plans of said improvement and said
companies have aqreed to make such necessary rearranqements immediately after
notification by said ~/Villaqe or the Department of Transportation.
(d) That it is hereby aqreed that the ~/Villaqe shall at its own eXpense, make
allrearranqementsof water mains, service lines, fire hydrants, valve boxes,
sanitary sewers or other municipally owned utilities and/or any appurtenances
thereto, which do not comply with the provisions of Directive 28-A, whether
inside or outside the corporate limits as may be necessary to conform to the
said improvement and said rearranqements shall be done at such time as re-
quested by the Department of Transportation Enqineer.

The funding participation, as stated before, is established in part by the
Village ordinance, in part by prior verbal agreement and by Department policy
contained in Directive No. 3D-A.
We believe the above proposed participation rates are consistent with the
i~tent and policies of Directive No. 3D-A. The Village has stated that they

SUBJECT: Re: Scioto Bridge Rehabilitation - Ordinance No: 31-83
Since Ordinance No: 75-78 was for bridge redecking only and Ordinance No:
61-82 contained no Estimated Cost breakdown, O.O.O.T. has now submitted a
new Ordinance which delineates the percentages of cost of the various seg-
ments including engineering.
Exhibit "A" attached to the Ordinance indicates that the Village portion of
all costs is a total of $414,100.00 of which $120,000.00 has already been
appropriated for the Bridge and Roadway approaches design engineering, leav-
ing a balance of approximately $294,000.00.
In order to keep the project progressing, O.O.O.T. has prepared the Ordinance
as emergency legislation and I respectfully request that Council dispense with
the three-time reading rule and pass this Ordinance as an emergency. After I
signed as Contractual officer, it would go to the Director, Ohio Department of
'J Transportation for his signature, which is a very important step in this pro-
cess. .
Per Mr. Bonnell of O.O.O.T., the Village share of the costs would have to be
posted during the advertising period and prior to the sale of the project by
0.0.0.1. In addition, I believe we have the option of placing these funds in
an escrow account and, could earn interest on said funds until they were re-
quired to pay for project costs.
Unfortunately, at this point of time, I do not know when these funds will be
required since the engineering is yet to be done, all necessary O.O.O.T. re-
views must be conducted and the establishment of an advertising date by O.O.O.T.
must then be determined.

improvement, under the supervision of the Director of Transportation.
WI~REAS. the Director of Transportation is considering improving a portion of the

Ohio:
SECTION I (Consent) :
That it is declared to be in the public interest that the consent of said~/
Village be and such consent is hereby given to the Director of Transportation to construct
the above described improvement, in accordance with plans, specifications and estimates
as approved by the Director.
SECTION II (Cooperation)
That said Village hereby proposes to cooperate with the State of Ohio, in
the cost of the above described improvement as follows:
J (a) By assuming and bearing one hundred percent (100%) of the cost of
Preliminary Engineering and all costs for added construction items
generating extra work contracts under Ohio Laws, unless performance is
approved by the State of Ohio and Federal Highway Administration before
work is authorized and 9ne hundred percent (100%) of the cost of the
upgrading of Traffic Signals at High Street and SR-257!US-33!SR-16l
intersections.
(b) Structure Rehabilitation wIll be financed using Federal BR funds at
Eighty percent (80%) Federal, Ten percent (10%) State and Ten percent (10%)
Village.
(c) Approach Roadway Reconstruction will be financed using Federal Primary funds
at Seventy-Five percent (75%) Federal, Ten percent (10%) State and
Fifteen pet'cent (15%) Village. )
(d) State review and inspection costs will be at project expense.
SECTION III (Authority to Sign)
That the Village Manager of said ~~~illag~, is h~re~~ emp~w~r~d and
directed on behalf of the ~/Village to enter into a9reemen~s with the Direc~or of
Trcnsportatlon necessary to complete the planning and construction of this improvement.

SECTION IV (Traffic Control Signals and Devices)

SECTION V (Maintenance and Parking)
That upon completion of said improvement, said Jfii8/village, will thereafter keep
said high~ay open to traffic at all times, and
(a) Maintain the improvement in accordance with the provisions of the statutes
relating thereto and make ample financial and other provisions for such
maintenancer and
I (b) Maintain the right-of-way and keep it free of obstructions in a manner satis-
factory to the state of Ohio and hold said right-of-way ~nviolate for public
highway purposes and permit no signs, posters, billboards, roadside stands
or other private installations within the right-of-way limits; and
(c) Place and,maintain all traffic control devices conforming to the Ohio Manual
of Uniform Traffic Control Devices on the improvement in compliance with the
provisions of Section 4511.11 and related sections of the Ohio Revised Code.
(d) Regulate parking in the following manner:
Prohibit parking within the limits of the improvement.
SECTION VI
Ordinance No. 61-82, passed November 1, 1982 and Ordinance No. 75-78,
Passed August 21, 1978 are hereby rescinded.
SECTION V~~Right-of-way, Utility Rearrangement and Saving the State of Ohio Harmless
of Damages)
J (a) That all existing street and public way right-of-way within the ~/
Village which is necessary for the aforesaid improvement', shall be made
available therefor.
(b) That the ~/Municipality will acquire any additional right-of-way
required for the construction of the aforesaid improvement.
(c) That arrangements have been or will be made with and agreements obtained
from all public utility companies whose lines or structures will be affected
by the said improvement and said companies have agreed to make any and all
necessary plant removals or rearrangements in such a manner as to be clear
of any construction called for by the plans of said improvement and said
companies have agreed to make such necessary rearrangements immediately after
notification by said ~/Village or the Department of Transportation.
(d) That it is hereby agreed that the ~/Village shall at its own expense, make
all rearrangements of water mains, service lines, fire hydrants, valve boxes,
sanitary sewers or other municipally owned utilities and/or any appurtenances
thereto, which do not comply with the provisions of Directive 28-A, whether
inside or outside the corporate limits as may be necessary to conform to the
said improvement and said rearrangements shall be done at such time as re-
quested by the Department of Transportation Engineer.
(e) That the construction, reconstruction, and/or rearrangement of both publicly
and privately owned utilities, referred to in subsections (c) and (d) above,
shall be done in such a manner as not to interfere unduly with the operation
of the contractor constructing the improvement and all backfilling of
trenches made necessary by such utility rearrangements shall be performed in
accordance with the provisions of the Ohio Department of Transportation
