AN ORDINANCE AMENDING THE TRAFFIC CODE AND ORDINANCE NUMBER 331. 37 TO PROHIBIT VEHICULAR TRAVEL UPON AND DAMAGE TO RIGHTS OF WAY, ABUTTING ROADS, AND AREAS OTHER THAN THE PAVED PORTION AND BERMS OF ROADWAY. , NOW THEREFORE BE IT"ORDAINED by the Council of the Village of Dublin, " members concurring, that: Section 1. The Village of Dublin Traffic Code and Section 331.37 thereof be and the same hereby are amended so that as amended the same shall read as follows: 331.37 DRIVING UPON SIDEWALKS, STREET LAWNS, CURBS, OR AREAS OTHER THAN PAVED PORTIONS OF ROADWAYS AND BERMS (a) No person shall drive or operate any vehicle, other I than a bicycle, upon a sidewalk or sidewalk area, except upon a permanent or duly authorized temporary driveway. (b) No person shall drive or operate any vehicle on a street lawn area or the curb of a street, except upon a permanent or duly authorized temporary driveway or when otherwise lawfully authorized. (c) No person shall negligently drive or operate any- vehicle, except in the event of an emergency, upon any area with n the right of way of any road, street, lane, avenue, or thoroughfa e including culverts, and adjoining grassy areas, other than upon the paved or graveled, normal travel, portion of the road, street lane, avenue, or thoroughfar~, or the adjo.ining berm. In the case of a berm, a vehicle shall only be operated in such area I for starting and stopping vehicles, emergencies, and when directe by law enforcement officials only. (d) In addition any person who operates a vehicle in a prohibited area as designated above and the lawful owner of the vehicle shall be liable to the municipality for any and all damages which may be incurred as a result of the failure to drive or operate said vehicle in a proper manner and on proper road surfaces. - . .. , . . That Ordinance 303.99 of the Codified Ordinanc s be and the same hereby is amended to provide as follows: I Whoever violates Section 33l.37(c) is guilty of a misdemea10r ! of the Fourth Degree.
