I AN ORDINANCE TO AMEND THE DUBLIN PLANNING AND ZONING CODE
AND TO ENACT CHAPTER 1184 TITLED SPECIAL PERMITS.
WHEREAS, the Village Council has passed legislation that requires the Dublin
Planning and Zoning Commission to review and approve permit applications for
certain land uses;
WHEREAS, there is no established procedure in the Dublin Planning and Zoning
Code that can be adapted to manage the review of unique land uses;
WHEREAS, the creation of Chapter 1184 titled Special Permits, will establish the
authority of the Planning and Zoning Commission to grant special permits and
will provide the supplemental criteria which shall be applied by the Planning
and Zoning Commission when reviewing applications for land uses so designated
by the Village Council of Dublin, Ohio;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State
of Ohio, 7 of the elected members concurring;
~ECTION~l. That the Planning and Zoning Code of Dublin, Ohio is hereby amended, ~
~nacting new Chapter 1184, Special Permits, to read as follows:

Special Permits
184.01 SPECIAL PERMITS
(a) PurpDse. To identify land uses which require a special permit due to uni-
que characteristics relative to location, design, size, operation, circu-
lation or need for public services and to provide supplemental criteria
which shall be applied by the Planning and Zoning Commission when review-
ing the proposed use.
b) Special Permit Required. Within the Village, no building, structure or
premises shall be used and no building or structure shall be erected
which is arranged, intended or designed to be used for any use speci-
fied in this Section except on Special Permit issued by the Planning
and Zoning Commission.
c) Powers and Duties of the Planning and Zoning Commission in regard to
Special Permits. The Planning and Zoning Commission shall have the
following powers and duties:
(1 ) To grant special permits for uses listed in Chapter 1184 where
it is shown that the special use can be granted without sub-
stantial impairment of the general purpose and intent of the
I zoning district in which the use is proposed to be located
and without significant incompatibility with the general
character of the neighborhood.
(2) To impose such requirements and conditions regarding the loca-
tion, character, and other features of the proposed uses or
structures as the Commission feels necessary to carry out the
intent and purpose of the Zoning Code and to otherwise safe-
guard the public safety and welfare.

I (3) Upon application by the Village Law Director, to revoke any
special permit whose condition has been violated after notice
and Dpportunity to conform have been given.
(d) Further, it shall be provided that any applicant who is denied a special
permit by the Planning and Zoning Commission may appeal such denial
directly to the Council of the Village of Dublin, Ohio.
SECTION 2. This Ordinance shall take effect and be in force from and after
the earliest period permitted by law.
