AN ORDI NANCE TO AMEND ORDI NANCE NO: 81-80
WHICH ESTABLISHED SEWER AND WATER BENEFIT SUR-
CHARGE CAPACITY FEES.
III WHEREAS, there appeara to be an inequity in Ordinance No: 81-80 wherein, a
private enterprise, in a Commer~ial or Industrial zoning district, takes the
initiative to construct a Sewer or Water utility and no assessments are levie ,
there is no provision to exempt said private enterprise from said Benefit Sur
charge Capacity Fees and;
WHEREAS, in new Residential developments wherein a private developer construe s
all internal Sewer and Water lines, there is no provision to exempt said pri-
vate developer from said Benefit Surcharge Capacity Fees;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State
of Ohio, t, of the elected members concurring:
SECTION 1.
SECTION 2. That the second sentence in Section 2 of Ordinance No: 81-80,
which reads as follows: "The fee shall be $2,500.00 for each unit proposed

mit and$11.QO per front foot upon application for a Water Tap Permit" be
amended by adding the'following language:

in a new residential development, at their own expense, the new units in said
new residential development shall be exempt from said Benefit Surcharge Capa-
city Fees.
SECTION 3. That this Ordinance shall take effect and be in force from and
after the earliest period allowed by law.
