RESOLUTION NO. 01-72. VILLAGE OF DUBLIN. OHIO
WHEREAS. for several years. a need has existed in the Village of
Dublin for a sanitary sewerage system; and
I WHEREAS. Council has considered the two po'Sible alternatives of
either building a treatment plant on the Scioto River to dispose of the
sewage from the Village of Dublin and the alternative of entering into a
contract with the City of Columbus whereby the Village of Dublin would
build a sewerage system within the Village and the City of Columbus would
construct trunk sewer lines to the Village of Dublin for the purpose of
receiving sewage from the Village's system and transporting said sewage
to the Columbus treatment plants for disposal thereat; and
WHEREAS. the Village officials have consulted with various state
and federal agencies with reference to the above alternatives; and

I WHEREAS. such state and federal agencies have discouraged the
I Village officials from undertaking to construct another treatment facility
on the Scioto River in the vicinity of Dublin, and have encouraged the Village
of Dublin to enter into a contract with the City of Columbus as described
above; and
WHEREAS, on the basis of such discussions, the Village officials
felt that the cooperation of such agencies would not be forthcoming were the
Village to attempt to construct a treatment facility on the Scioto River, and
that the cooperation of such agencies would be necessary tn order to
establish such a facility; and
WHEREAS, the Village of Dublin. because of the above, undertook
to negotiate a contract with the City of Columbus, and after several years of
I' negotiation. a contract was entered into between the City of Columbus and
the Village of Dublin whereby the City of Columbus agreed to build trunk
sewers to the Village of Dublin for the purpose of receiving sewage from the
Village sewerage system; and
WHEREAS. the City of Columbus undertook to construct such a
trunk sewer, and certain owners of land along the Scioto River filed a suit
in the Common Pleas Court of Franklin County, Ohio, to enjoin the City of

Columbus from constructing such trunk sewer along the west bank of the
~ Scioto River; and

~ WHEREAS# the Common Pleas Court of Franklin County# Ohio. has

held that the City of Columbus cannot build such a trunk sewer; and
i WHEREAS# the need for a sewerage system and a suitable means of
I disposing of sewage from the Village of Dublin continues to exist and is
I extremely urgent; and ,I
WHEREAS# the Village of Dublin is faced with an apparent dilemma :1
because of the facts set forth above: I
NOW. THEREFORE. BE IT RESOLVED by the Council of the Village
of Dublin. State of Ohio# S-- of the members elected thereto concurring:i
SECTION 1. That the Council of the Village of Dublin go on record il
as follows:
1. As being extremely displeased with the holding of the Common
Pleas Court of Franklin County. Ohio. that the City of Columbus ~
cannot build a sewer line to the Village of Dublin# and as ;1
wholeheartedly endQrsing the efforts of the City of Columbus to
reverse that decision;
2. That Council continues to favor disposing of the Village's sewage
into a trunk line constructed by the City of Columbus for that
I purpose and disposing of said sewage at the Columbus disposal
plant; and
3. That the Village of Dublin must in the near future establish some
suitable means of disposing of the sewage of the Village of Dublin.
SECTION 2. That the Mayor be# and he hereby is. authorized and

directed to discuss with appropriate federal and state agencies and with the '
land owners and residents of the Dublin community, the problem faced by the
Village of Dublin with respect to establishing a sewerage system and disposing
of the sewage; and to enlist the help of all such appropriate agencies. land
owners and residents in finding some suitable means of establishing a
sewerage system for the Village of Dublin and disposing of sewage.
