Ordinance 34-12RECORD OF ORDINANCES Ordinance No. 34 -12 Passed 20 AN ORDINANCE AMENDING ORDINANCE 54 -11 TO REVISE THE FEES IN APPENDIX A OF THE SCHEDULE OF FEES AND SERVICE CHARGES FOR CITY OF DUBLIN SERVICES TO INCLUDE BRIDGE STREET CORRIDOR APPLICATION AND REVIEW FEES, AND DECLARING AN EMERGENCY WHEREAS, the City of Dublin adopted Ordinance 54 -11 on October 10, 2011 which established City policies as to the recovery of costs and more particularly the percentage of full costs to be recovered from users of the City's services and authorized a Schedule of Fees and Charges for City Services, which complies with the policy set forth in that Ordinance; and WHEREAS, the City of Dublin adopted Ordinance 08 -12 on April 9, 2012 for the area rezoning to Bridge Street Corridor (BSC) zoning districts, which necessitates establishment of new fees for these districts in the City's Schedule of Fees and Charges for City Services; and WHEREAS, Ordinance 54 -11 includes a provision and guidelines for adding new fees to the established Schedule of Fees and Charges for City Services during the year stating that: Should it become necessary to establish a new service fee or charge during the year, the City Manager may set the fee administratively. Any such fees set by the City Manager shall be reported to the City Counci/ at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance. The new service will then be included and analyzed in the next rate review. WHEREAS, after further review and consideration, a list of fees associated with the new BSC application procedures has been prepared and will be applied temporarily until the fees are examined in the citywide Cost of Services fee study later this year. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, —7— members of the elected officials concurring that: Section 1. This ordinance is declared to be an emergency necessary for the immediate preservation of the public peace, health, safety or welfare, and for the further reason that emergency passage is necessary in order to ensure that fees are in place at the time of the effective date of the Bridge Street Corridor area rezoning on May 9, 2012. Grigsby, City Manager Date: May 3, 2012 Initiated By: Angel Mumma, Deputy City Manager /Director of Finance & Administration Steve Langworthy, Director of Land Use & Long Range Planning Re: Ordinance 34 -12 - Amending Ordinance 54 -11 to include the Bridge Street Corridor (BSC) Application and Review Fees Background Dublin City Council adopted the area rezoning to Bridge Street Corridor (BSC) zoning districts on April 9, 2012. The effective date of this ordinance is May 9, 2012, at which time property owners may bring forward applications for development of land within the Corridor under the new BSC zoning regulations adopted by Council on March 26, 2012. Fee Schedule Revision Ordinance 34 -12 proposes a revision to the Schedule of Fees and Service Charges for City of Dublin Services to provide fees for the new application procedures associated with the BSC zoning regulations. Due to the potential for applications to be submitted soon after the effective date of the BSC area rezoning, an amendment to the fee schedule coinciding with the effective date of the area rezoning is necessary. The City's current fee Ordinance (54 -11) includes a provision and guidelines for new fees to be established during the year: Section 35.83 Schedule ofFees and Service Charges ()q Should it become necessary to establish a new service fee or charge during the year, the City Manager may set the fee administratively. Any such fees set by the City Manager shall be reported to the City Council at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance. The new service will then be included and analyzed in the next rate review. Staff has prepared a list of fees associated with the new BSC application procedures, consistent with the anticipated staff time and meeting expenses associated with other existing Land Use and Long Range Planning development application fees. The proposed fees associated with the BSC applications will be applied temporarily until they are examined in the citywide fee study update later this year. At that time, staff will have the ability to study the actual time and resources dedicated to the new application procedures, once applications are filed. Recommendation Staff recommends that Council dispense with the second reading /public hearing and adopt Ordinance 34 -12 by emergency to ensure that fees are in place at the time of the effective date of the Bridge Street Corridor area rezoning on May 9, 2012.
