Ordinance 24-12RECORD OF ORDINANCES Ordinance No. 24 -12 Passed . 20 AN ORDINANCE APPROPRIATING A COMBINED 0.360 ACRES, MORE OR LESS, FEE SIMPLE INTEREST, A 1.534 ACRES, MORE OR LESS, FEE SIMPLE INTEREST THAT IS PRESENT ROAD OCCUPIED PROPERTY, AND A 0.514 ACRES, MORE OR LESS, PERMANENT EASEMENT FROM SUBSIDIARY DEVELOPMENT CORPORATION, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin ( "City ") is preparing to construct a roundabout at the intersection of Cosgray and Shier -Rings Roads ('Project "); and WHEREAS, this roadway project will require the City of Dublin to obtain fee simple interests, fee simple interests that are present road occupied property, and permanent easements from Subsidiary Development Corporation ( "SDC ") as described and depicted in the legal descriptions attached hereto as Exhibit "A ", said property interests located in the City of Dublin, County of Franklin, State of Ohio; and WHEREAS, representatives of the City of Dublin have partaken in good faith negotiations with the landowner, but these negotiations have been unsuccessful thus far. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, --7— of the elected members concurring that: Section 1. Council hereby authorizes the City to appropriate, for the purpose of the Cosgray /Shier -Rings Road roadway improvement project, fee simple interests of an approximate 0.258 acres and 0.102 acres, fee simple interests that are present road occupied property of an approximate 0.423 acres, 0.156 acres, and 0.955 acres, and permanent easements of an approximate 0.353 acres and 0.161 acres, from Subsidiary Development Corporation. Section 2. Council hereby fixes the value of the interests to be appropriated at eighteen thousand eight hundred eleven dollars ($18,811.00), which sum, in the event negotiations are unsuccessful, shall be deposited with the Franklin County Court of Common Pleas. Section 3. Council finds that possible appropriation is necessary for roadway construction, specifically the construction of a roundabout at the intersection of Cosgray Road and Shier - Rings Road, and that the City intends to take immediate possession of the property upon making the requisite deposit with the Franklin County Court of Common Pleas. Section 4. The City Law Director is hereby authorized to file a petition for appropriation in the Franklin County Court of Common Pleas should it become necessary. Section 5. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The appropriation of the property interests described herein is necessary to the vehicular and pedestrian safety of City residents, as well as those individuals traversing the intersection of Cosgray and Shier -Rings Roads. DATE: May 3, 2012 RE: Ordinance No. 24 -12 Cosgray Road/Shier -Rings Road Roundabout Project Subsidiary Development Corporation PROJECT BACKGROUND: The City of Dublin ( "City ") is preparing to construct a roundabout at the intersection of Cosgray and Shier -Rings Roads (the "Project"). The City must obtain property interests from various landowners located within the City in order to construct this project The City presented good faith offers to each of theselandowners in accordance with the Ohio Revised Code. One of the landowners that the City must obtain various property interests from in order to construct the Project is Subsidiary Development Corporation ( "SDC'). After engaging in a lengthy period of negotiations with SDC, it appears that the City may be forced to appropriate the needed property from SDC. While the City remains hopeful that an amicable resolution can be reached with SDC, this Ordinance represents the next step in the appropriation process. APPROPRIATION INTRODUCTION: This memorandum discusses the appropriation of property interests owned by Subsidiary Development Corporation. The City will be acquiring from SDC two (2) fee simple interests, multiple fee simple interest that are present road occupied property, and two (2) permanent easements located within Franklin County Parcel Nos. 272 - 000195 and 272 - 000085, as depicted in the map attached to this memorandum.
