Ordinance 29-12RECORD OF ORDINANCES Ordinance No. 29 -12 Passed . 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION TO ACCEPT THE DEDICATION OF A 0.010 ACRES, MORE OR LESS, MULTI -USE PATH, DRAINAGE AND GRADING EASEMENT, AND A 0.238 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION AND GRADING EASEMENT FROM ITALIA HOMES, INC. WHEREAS, the City of Dublin ( "City") is preparing to construct a bike path along Martin Road from Martin Commons Park to the existing bike path located on Stoneridge Lane ( "Project "); and WHEREAS, said project requires that the City obtain certain property interests in Franklin County parcel nos. 273- 012289 and 273 - 012288, owned by Italia Homes, Inc.; and WHEREAS, Italia Homes, Inc. is willing to dedicate the property interests in Franklin County parcel nos. 273 - 012289 and 273 - 012288 to the City as set forth in the legal descriptions attached hereto, and the City is willing to accept said dedication. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, IT of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all documentation necessary to accept the dedication of an approximate 0.010 acres, more or less, permanent multi -use path, drainage and grading easement, and a 0.238 acres, more or less, temporary construction and grading easement from Italia Homes, Inc., as set forth in the legal descriptions attached herewith. Section 2 . This ordinance shall take effect on the earliest date permitted under applicable law. Bike Path Connection 2011 Street Maintenance Program —Phase 2 PROJECT BACKGROUND: The City of Dublin ( "City ") is preparing to construct a bike path from Martin Commons Park to the existing bikepath located on Stoneridge Lane ( "Project'). The City must acquire certain property interests from the adjacent landowners, Italia Homes, Inc. in order to construct this project After engaging in amicable negotiations, Italia Homes, Inc. has agreed to dedicate the necessary property interests to the City. 11161 9E0I1 [Glen I911 No] 111141Y1619II Italia Homes, Inc. is dedicating to Dublin the following property interests located within Franklin County parcel nos. 273 - 012289 and 273 - 012288, as visually depicted in the attached map: Property Interest Accepting ACRES 1. Temporary Construction and Grading 0.238 Easement ACTION TO BE AUTHORIZED BY ORDINANCE: Ordinance No. 29 -12 would allow the City Manager to execute all necessary conveyance documentation to formally accept the dedication of the aforementioned property interests. RECOMMENDATION: Staff recommends approval of Ordinance No. 29 -12 at the second reading/public hearing on May 7, 2012 as obtaining the property interests described herein is necessary for the furtherance of the construction of the bike path connection between Stoneridge Lane and Martin Commons Park.
