II DmECTING THE VILLAGE SOLICITOR TO TAKE
! WHATEVER LEGAL ACTION IS NECESSARY TO PRO-
TECT THE VILLAGE'S RIGHTS IN AND TO AN EASE-
,I MENT ACROSS CERTAIN PROPERTY WITHIN THE
, ,',I VILLAGE AND TO PROTECT THE VILLAGE'S RIGHTS
[", TO MAINTAIN AND USE THE PUMP HOUSE AND PIPE
i ; LINE CONSTRUCTED ON SAID PROPERTY.
WHEREAS. on De-<-, t 4--, 1966, Council passed Resolution
No. Dq -foro, the substance of which was as follows:
" "Section 1. That. whereas the Village of Dublin !
j for over a period of 21 years has been in open and
j notorious adverse possession of the real estate lQcated
I along the Bcloto River south of the State Highway right-
I of-way of state Route 33 to Mr. Parker Eberly's land
: by virtue of constructing, maintaining and using a road I
j thereon and constructing. maintaining and using a fire
J pump house thereon. that the Village is therefore the !
j legal and equitable owner of the real estate by virtue of !
i such possession. " I

!i "Section 2. That the Village Solicitor is hereby
ii directed to commence legal proceedings to quiet title
I'i to this real estate in the Village of Dublin as soon as
\r-:' possible. " ; and

.., WHEREAS. new information concerning the construction. main-
tenance and operation of the fire pump house and road mentioned in Resolution
No. o'1-~(;', has come to the attention of Council. I
NOW THEREFORE, BE IT RESOLVED by the Council of the
Village of Dublin. State of Ohio to of the elected members concurring:
SECTION 1. That Resolution No. D9-~h be and it hereby is

SECTION 2. That the Village Solicitor be and he is hereby di-
rected to take whatever legal action is necessary to protect the Village's
rights in and to the easement and right-of-way, commonly known as the fire
road. across the real estate located along the west side of the Scioto River and
immediately south of U. S. Route 33 - State Route 161 and to protect the right
of the Village to maintain and use the pump house and pipe line constructed
thereon.
