Resolution No. 22 -12 Passed 20 A RESOLUTION OF INTENT TO APPROPRIATE A 0.110 ACRES, MORE OR LESS, FEE SIMPLE INTEREST THAT IS PRESENT ROAD OCCUPIED PROPERTY FROM MITCHELL E. HAAF AND KIMBERLY S. HAAF WHEREAS, the City of Dublin is preparing to construct a roundabout project at Cosgray Road and Shier -Rings Road; and WHEREAS, this roadway project will require the City of Dublin to obtain a fee simple interest that is present road occupied property from Mitchell E. Haaf and Kimberly S. Haaf, as described and depicted in the legal description attached hereto as Exhibit "A ", said property interest located in the City of Dublin, County of Franklin, State of Ohio. NOW, THERERE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, of elected members concurring that: Section 1. Council considers it necessary and declares its intention to appropriate, for the purpose of constructing a roadway improvement project at Cosgray Road and Shier -Rings Road, a fee simple interest that is present road occupied property as described and depicted in the attached Exhibit A, from Mitchell E. Haaf and Kimberly S. Haaf. Section 2. The City Manager is hereby authorized to cause written notice of the passage of this Resolution to be served upon the owners and persons in possession or having an interest of record in the property described in Exhibit A, and this notice shall be served according to law. Section 3. This Resolution shall take effect and be in force from and after the earliest date permitted by law. Passed this � day of 2012. DATE: April 5, 2012 RE: Resolution No. 22 -12 Cosgray Road/Sher -Rings Road Roundabout Project Mitchell E. Haaf and Kimberly S. Haaf PROJECT BACKGROUND: The City of Dublin ( "City ") is preparing to construct a roundabout at the intersection of Cosgray and Shier -Rings Roads (the 'Project'). The City must obtain property interests from various landowners located within the City in order to construct this Project. Landowners that the City must obtain property from for the construction of the Project are Mitchell E. Haaf and Kimberly S. Haaf (collectively the "Grantor "). After engaging in a lengthy period of negotiations with the Grantor, it appears that the City may need to appropriate the needed property from the Grantor in order to proceed with the project. The City is still hopeful that an amicable resolution can be reached with the Grantor, however, this Resolution begins the eminent domain process in the event that negotiations are unsuccessful. PROPERTY TO BE APPROPRIATED: The appropriation consists of the following property interests, as depicted in the map attached hereto: Franklin County Parcel No. 272 - 000586 Present Road Occupied 1 0.110 f acres $300 RECOMMENDATION: The Law Department recommends approval of Resolution No. 22 -12 as the improvement of the intersection of Cosgray Road and Sher -Rings Road is necessary for public safety and approval of the Resolution will keep the Project moving forward. The above description of a right -of -way parcel was prepared and reviewed on May 4, 2011 by Brian P. Bingham, registered professional surveyor number 8438, is based on an actual field survey of the premises performed by American Structurepoint, Inc, in July 2009, complies with the "Minimum Standards for Boundary Surveys" described in O.R.C.
