35-76 Resolution - --.. --.. RESOLUTION NO. ~S".,.. DECLARING THE NECESSITY OF IMPROVING CERTAIN STREETS IN RIVER FOREST SUBDIVISION BY THE CONSTRUCTION OF WATER LINES AND APPURTENANCES AND DECLARING AN EMERGENCY 0 BE IT RESOLVED by the Council of the Village of Dublin, Counties of Franklin and Delaware, State of Ohio, three-fourths of all members elected thereto concurring: Section 1. That it is necessary to construct waterlines, services, fire hydrants and appurtenances in certain streets in River Forest Subdivision as follows: Construct a 12 inch waterline on Dublin-Bellpoint Road (SR 745) from the intersection of Ashford Road North to a point 142 feet south of the intersection of River Forest Road; Construct an 8 inch waterline on Ashford Road from the intersection of Dublin-Bellpoint Road (SR 745) west and north to the intersection of Indian Hill Road; Construct an 8 inch waterline on River Forest Road from the intersection of Dublin-Bellpoint Road (SR 745) west and north to the intersection of Indian Hill Road; Construct an 8 inch waterline on Indian Hill Road from U the intersection of River Forest Road north and west to a point 447 feet west of the intersection of Ashford Road; Construct a 6 inch waterline on Bennett Court from the intersection of Indian Hill Road west a distance of 380 feet, thence continuing on with a 3 inch waterline for a distance of 120 feet to the end of Bennett Court; as shown on the plans hereinafter referred to, prepared by Burgess & Niple Limited, Consulting Engineers. It is hereby determined by this Council that ~ the aforesaid streets to be improved as herein provided are so situated in ' relation to each other that in order to complete the improvement thereof in the most practical and economical manner they should be improved at the same time, with the same kind of materials and in the same manner. Section 2. That the grade of said water improvements shall be the grade as shown by the engineer's plans and profiles which are made a part hereof. Section 3. That the plans, specifications, estimates and profiles of the proposed improvement, heretofore prepared by the engineer and now on file in the office of the clerk are hereby approved. Section 4. That the entire cost of said improvement less one- 0 fiftieth of said entire cost, the cost of intersections, plus the cost of oversizing the 12 inch waterline on SR 745 over the cost of an 8 inch water- line which shall be paid by the Village of Dublin shall be assessed in pro- portion to the benefits upon all lots and lands bounding and abutting upon the proposed improvement between and including the termini of said improve- ment. The cost of said improvement shall include the cost of preliminary and other surveys, plans, specifications, profiles and estimates and of print- ing, serving and publishing notices, resolutions and ordinances, the amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the interest thereon, the costs incurred in connection with the preparation, levy and collection of the special assess- ments, the cost of purchasing, appropriating less 50%, and otherwise acquiring \, .,~ I . . . . therefor any required real estate or interests therein, expenses of legal services including obtaining an approving legal opinion, cost of labor and material and interest on bonds and notes issued in anticipation of the levy and collection of the special assessments together with all other necessary expenditures. Section 5. That the consulting engineer be and it is hereby author- ized and directed to prepare and file in the office of the clerk the estimated e assessments of the cost of the improvement described in this resolution. Such estimated assessments shall be based upon the estimate of cost of said improve- ment now on file in the office of the clerk and shall be prepared pursuant to the provision of this resolution. When such estimated assessments have been so filed, said clerk shall cause notice of the adoption of this resolution and the filing of said estimated assessments to be served on the owners of all lots and lands to be assessed as provided in RC 5727.13. Section 6. That the assessments to be levied shall be paid in 20 annual installments, with interest on deferred payments at the same rate as shall be borne by the bonds to be issued in anticipation of the collection thereof; provided, that the owner of any property assessed may, at his option, pay such assessment in cash within thirty days after passage of the assessing ordinance. Section 7. That bonds of the village shall be issued in anticipation of the collection of assessments by installments and in an amount equal thereto and notes of said village shall be issued in anticipation of the issuance of such bonds and the levy of such assessments. Section 8. Thil!j'resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of said Village, and for the further reason that the immediate construction of said improvement is necessary to provide an adequate and potable water supply in areas to be assessed and eliminate health hazards; wherefore, U this resolution shall be in full force and effect from and immediately after its passage.
