Ordinance No. 12 -12 Passed 20 AN ORDINANCE AUTHORIZING THE APPROPRIATION OF A 0.049 ACRES, MORE OR LESS, FEE SIMPLE INTEREST, A 0.249 ACRES, MORE OR LESS, FEE SIMPLE INTEREST, A 0.156 ACRES, MORE OR LESS, PERMANENT EASEMENT, A 0.187 ACRES, MORE OR LESS, PERMANENT EASEMENT, A 0.304 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT, AND A 0.211 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM BRE/COH OH LLC (BLACKSTONE), AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin ( "City ") is preparing to construct a roadway project to widen Emerald Parkway between Tuttle Crossing Boulevard and Rings Road; WHEREAS, this roadway project will require the City of Dublin to obtain fee simple interests, permanent easements and temporary construction easements from BRE/COH OH LLC (Blackstone Properties) as described and depicted in the legal descriptions attached hereto as Exhibit "A ", said property interests located in the City of Dublin, County of Franklin, State of Ohio; and WHEREAS, representatives of the City of Dublin have partaken in good faith negotiations with the landowner, but these negotiations have been unsuccessful thus far. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, T of the elected members concurring that: Section 1. Council hereby authorizes the City to appropriate, for the purpose of the Emerald Parkway widening roadway improvement project, fee simple interests of an approximate 0.049 acres and 0.249 acres, permanent easements of an approximate 0.156 acres and 0.187 acres, and temporary construction easements of an approximate 0.304 acres and 0.211 acres, from BRE /COH OH LLC (Blackstone Properties). Section 2. Council hereby fixes the value of the interests to be appropriated at three hundred three thousand seven hundred fifty -five dollars ($303,755), which sum, in the event negotiations are unsuccessful, shall be deposited with the Franklin County Court of Common Pleas. Section 3. Council finds that possible appropriation is necessary for roadway construction, specifically the widening of Emerald Parkway between Tuttle Crossing Boulevard and Rings Road, and that the City intends to take immediate possession of the property upon making the requisite deposit with the Franklin County Court of Common Pleas. Section 4. The City Law Director is hereby authorized to file a petition for appropriation in the Franklin County Court of Common Pleas should it become necessary. Section 5. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The appropriation of the property interests described herein is necessary to the vehicular and pedestrian safety of City residents, as well as those individuals traversing Emerald Parkway within the subject construction area. The ordinance shall therefore take effect immediately upon passage. Hammersmith, P.E., Director of Engineering /City Engineer DATE: February 23, 2012 RE: Ordinance No. 12 -12 Emerald Widening Project— Tuttle Crossing Boulevard to Rings Road BRE /COH OH LLC (Blackstone) PROJECT BACKGROUND The City of Dublin ( "Dublin ") is working in cooperation with the City of Columbus ( "Columbus ") to widen Emerald Parkway between Tuttle Crossing Boulevard and Rings Road (the "Project "). The Project is being funded, in part, by a grant from the Ohio Public Works Commission ( "OPWC "), secured in October of 2009. The OPWC has provided Dublin and Columbus with several extensions for use of the grant monies so that both cities could work cooperatively with landowners regarding access and the acquisition of the necessary right -of- way for the Project. The OPWC recently approved an extension to the grant which dictates that that construction must begin in April of 2012. The Project was advertised for bid on February 2, 2012, and the need to obtain all of the right -of -way for the Project has become immediate. It is imperative that the project remain on schedule in order to retain the OPWC grant. APPROPRIATION INTRODUCTION: This memorandum discusses the appropriation of property interests owned by BRE /COH OH LLC (referred to herein as "Blackstone "). In December of 2011, Blackstone acquired all of the property on Emerald Parkway that was previously owned by Duke Realty Ohio ( "Duke "). Dublin had a relationship with Duke, and fully expected to amicably negotiate the donation/acquisition of necessary property interests from Duke without having to use the appropriation process. In October of last year, Dublin learned that Duke was selling its property to Blackstone. Dublin attempted to secure the property it needed from Duke prior to Duke's sale, but Duke could not do so in accordance with its purchase agreement with Blackstone. Through Duke, Dublin then attempted to work with Blackstone to obtain the necessary property interests. Dublin began communicating directly with Blackstone. Dublin will continue to work with representatives of Blackstone to gain the donation of right -of -way needed for the Project. However, in order to be in a position to commence construction of the project by the end of April 2012, Dublin must have the authority to appropriate the necessary property should it become necessary.
