Ordinance 10-12RECORD OF ORDINANCES Ordinance No. 10 -12 Passed 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION TO ACQUIRE A 1.035 ACRES (WITH 0.574 ACRES AS PRESENT ROAD OCCUPIED), MORE OR LESS, FEE SIMPLE INTEREST, A 0.286 ACRES, MORE OR LESS, PERMANENT UTILITY, GRADING AND DRAINAGE EASEMENT, AND A 0.076 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION AND GRADING EASEMENT FROM STEPHEN M. KELLY, GRANTOR AND TRUSTEE, OR ANY SUCCESSOR TRUSTEE, OF THE STEPHEN M. KELLY TRUST, DATED MARCH 19, 2011, ROBERT E. LEMBACH, AND DENNIS THIERGARTNER. WHEREAS, the City of Dublin (the "City') is preparing to construct a roundabout at the intersection of Cosgray Road and Shier -Rings Road; and WHEREAS, said roadway project requires that the City obtain certain property interests within Franklin County Parcel No. 272 - 000166 owned by Stephen M. Kelly, Trustee, or any successor Trustee of the Stephen M. Kelly Trust dated March 19, 2011, Robert E. Lembach, and Dennis Thiergartner (the "Grantors "), said property interests more fully described in the Exhibits labeled "A" and depicted in the Exhibits labeled 'B ", all attached hereto; and WHEREAS, the City and the Grantors participated in good faith discussions and have come to mutually agreeable terms for the acquisition of the necessary property interests; and WHEREAS, the City desires to execute necessary conveyance documentation to complete the transaction between the City and the Grantors. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, —7— of the elected members concurring, that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire an approximate 1.035 acre (with 0.574 acres as present road occupied), fee simple interest, an approximate 0.286 acre permanent utility, grading and drainage easement, and an approximate 0.076 acre temporary construction and grading easement from Stephen M. Kelly, Trustee, or any successor Trustee of the Stephen M. Kelly Trust dated March 19, 2011, Robert E. Lembach, and Dennis Thiergartner, said property interests located within Franklin County Parcel No. 272 - 000166, and as more fully described and depicted in the attached Exhibits "A" and "B ". Acquisition Cosgray /Shier -Rings Road Roundabout Project PROJECT BACKGROUND: The City of Dublin ( "City") is preparing to construct a roundabout at the intersection of Cosgray and Shier -Rings Roads (the "Project'). The City must obtain property interests from various landowners located within the City in order to construct this project. The City presented good faith offers to each of these landowners in accordance with the Ohio Revised Code. One of the landowners that the City must obtain these property interests from for the construction of the Project is Stephen M. Kelly, Trustee, or any successor Trustee of the Stephen M. Kelly Trust dated March 19, 2011, Robert E. Lembach, and Dennis Thiergartner (the "Grantors "). After engaging in amicable negotiations, the City has come to an agreement with the Grantors to acquire these necessary property interests pursuant to the terms outlined in this memorandum. ACQUISITION INTRODUCTION: The City will be acquiring from the Grantors only those property interests necessary for the construction of the Project as depicted in the map attached to this memorandum. RECOMMENDATION: Staff recommends approval of Ordinance 10 -12 at the second reading/public hearing on February 27 as obtaining the property interests is necessary for the furtherance of the Cosgray /Shier -Rings Road roundabout construction project.
