RECORD OF ORDINANCES Ordincrrtce No. 68-08 Passed 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ACCEPT THE DEDICATION OF A COMBINED 1.408 ACRES, MORE OR LESS, FEE SIMPLE INTEREST, A COMBINED .086 ACRES, MORE OR LESS, TEMPORARY EASEMENT, A COMBINED .834 ACRES, MORE OR LESS, EASEMENT FOR THE CONSTRUCTION AND MAINTENANCE OF SLOPES, AND A COMBINED .056 ACRES, MORE OR LESS, PERPETUAL EASEMENT TO CONSTRUCT AND MAINTAIN A SEWER FROM OHIOHEALTH CORPORATION, SAID ACREAGE LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF U.S. 33 AND AVERY-MUIRFIELD DRIVE, CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, AND TO ESTABLISH A STREET NAME FROM THE DEDICATED ACREAGE, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin ("City") is undertaking a road improvement project to relieve traffic and improve safety in the Avery-Muirfield Drive north corridor; and WHEREAS, in order to relieve traffic and improve safety in the Avery-Muirfield Drive north corridor, City shall construct an ingress lane to relieve traffic near Dublin Methodist Hospital; and WHEREAS, said improvement will require the City of Dublin to obtain or receive dedication of a fee simple interest, temporary construction easement, easement for the construction and maintenance of slopes, and an easement to construct and maintain a sewer in and to the premises described in the attached Exhibit "A", Exhibit "B", Exhibit "C", Exhibit "D", Exhibit "E", Exhibit "F", Exhibit "G", Exhibit "H", Exhibit "I", Exhibit "J", Exhibit "K", Exhibit "L", Exhibit "M", Exhibit "N", Exhibit "O", and Exhibit "P" located in the City of Dublin, County of Franklin, State of Ohio; and WHEREAS, the owner of the property required for City to construct the ingress lane as set forth in the attached Exhibits, OhioHealth Corporation (d.b.a. Hospital Properties, Inc.), desires to dedicate the requisite land to City; and WHEREAS, this ordinance authorizes the City Manger to enter into an agreement to accept said dedication and shall establish the name of the ingress lane. NOW, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, _~ of the elected members concurring that: sewer from OhioHealth Corporation, said acreage the intersection of U.S. 33 and Avery-Muirfield Franklin, State of Ohio. Section 1. The City Manager is hereby authorized to execute an agreement accepting a dedication of land from OhioHealth Corporation (d.b.a. Hospital Properties, Inc.) for the construction of an ingress lane of a combined 1.408 acres, more or less, fee simple interest, a combined .086 acres, more or less, temporary easement, a combined .834 acres, more or less, easement for the construction and maintenance of slopes, and a combined .056 acres, more or less, perpetual easement to construct and maintain a located at the northwest corner of Drive, City of Dublin, County of Section 2. Council hereby establishes that the name of the ingress lane shall be "Dublin Methodist Lane." Section 3. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. Hartmann, Assistant Law Director DATE: August 14, 2008 RE: Ordinance 68-08 Land Dedication and Naming of Street - OhioHealth Property Construction of Ingress Lane PROJECT BACKGROUND: The City of Dublin is undertaking a road improvement project to relieve traffic and improve safety in the Avery-Muirfield Drive north corridor. Specifically, the City will construct an ingress lane to relieve a heavy traffic area around Dublin Methodist Hospital. The concept for the hospital ingress lane was brought before Dublin City Council in January 2006, as part of the Avery-Muirfield Drive north corridor staff report. Staff recommended construction of the ingress only lane based on the safety analysis conducted for that report. The study indicated that nearly sixty-seven percent (67%) of all crashes on Avery-Muirfield Drive, from the U.S. 33 westbound ramps and Post Road, are south of Perimeter Loop Road/Hospital Drive. Construction of the ramp will remove the hospital related traffic from the westbound off-ramp from U.S. 33 and the continuous north bound right turn movement, which will improve safety in the corridor. The City of Dublin and Ohio Health worked successfully with the state legislature to secure a one million dollar ($1,000,000) road work grant from the Ohio Department of Development toward design and construction of the ingress lane. DEDICATION: OhioHealth Corporation shall dedicate property to the City consisting of a combined 1.408 acres, more or less, fee simple interest, a combined .086 acres, more or less, temporary easement, a combined .834 acres, more or less, easement for the construction and maintenance of slopes, and a combined .056 acres, more or less, perpetual easement to construct and maintain a sewer.
