AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT TO PURCHASE A COMBINED 1.429 ACRES, MORE OR LESS, FEE SIMPLE INTEREST (WITH 0.554 ACRES, MORE OR LESS, PRESENT ROAD OCCUPATION), A 0.382 ACRES, MORE OR LESS, UTILITY EASEMENT, A 0.293 ACRES, MORE OR LESS, STANDARD HIGHWAY EASEMENT, AND A COMBINED 0.428 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM ROGER W. GORDEN, SAID ACREAGE LOCATED ON THE EAST SIDE OF HYLAND-CROY ROAD, TOWNSHIP OF JEROME, COUNTY OF UNION, STATE OF OHIO, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin is preparing to improve the U.S. Highway 33 and State Route 161 Interchange in Franklin and Union Counties; and WHEREAS, said improvement will require the City of Dublin to obtain a fee simple interest, utility easement, standard highway easement, and temporary construction easement in and to the premises described in the attached Exhibit "A", Exhibit "B", Exhibit "C", Exhibit "D", Exhibit "E" and Exhibit "F" located in the Township of Jerome, Union County, Ohio. WHEREAS, the City desires to enter into a real estate purchase contract for the purchase of a 1.429 acres, more or less, fee simple interest (with 0.554 acres, more or less, present road occupation), a 0.382 acres, more or less, utility easement, a 0.293 acres, more or less, standard highway easement, and a combined 0.428 acres, more or less, temporary construction easement in and to the premises located in the Township of Jerome, County of Union, State of Ohio for the U.S. Highway 33 and State Route 161 Road Improvement for three hundred sixty-five thousand dollars ($365,000). NOW, TFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute a real estate purchase contract and any necessary closing documentation related to the acquisition of property from Roger W. Gorden, Trustee of the Roger Warren Gorden Living Trust, and Denise Ann Gorden, Trustee of the Denise Ann Gorden Living Trust, and paying any related costs. This property consists of a 1.429 acres, more or less, fee simple interest (with 0.554 acres, more or less, present road occupation), a 0.382 acres, more or less, utility easement, a 0.293 acres, more or less, standard highway easement, and a combined 0.428 acres, more or less, temporary construction easement. Section 2. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The reason for such necessity is that the prompt improvement of U.S. Highway 33 and State Route 161 Interchange in Franklin and Union Counties is necessary to improve traffic circulation and relieve traffic congestion for the citizens of Dublin. Hartmann, Assistant Law Director DATE: August 14, 2008 RE: Ordinance No. 64-08 Land Acquisition -Gorden Property U.S. Highway 33 and State Route 161 Interchange Improvement Project PROJECT BACKGROUND: The City of Dublin and the Ohio Department of Transportation (ODOT) are working together to make improvements to the US 33/SR 161/Post Road interchange. The current "tight diamond" configuration will be changed to a "Pardo A" configuration. This change means that loop ramps will be introduced to eliminate the need for left turns from the arterial road (i.e. S.R. 161 /Post Road) onto the freeway (U.S. 33). This project requires the acquisition of either a "partial take" (the purchase of a portion of the parcel for right-of--way) or a "total take" (the purchase of the entire parcel) from multiple property owners along this interchange. ACQUISITION INTRODUCTION: This memorandum discusses the Gorden property acquisition. The Gorden property consists of a 1.429 acres, more or less, fee simple interest (with 0.554 acres, more or less, present road occupation), a 0.382 acres, more or less, utility easement, a 0.293 acres, more or less, standard highway easement, and a combined 0.428 acres, more or less, temporary construction easement in and to the premises located in the Township of Jerome, County of Union, State of Ohio. ACTION TAKEN IN THIS CASE: Since the year 2006, the Law Department has been in contact with the landowners to inform them of the upcoming construction and effect of the interchange improvement to their property. The property owners, Roger W. and Denise A. Gorden, are the contact persons for this appropriation. The Law Department also engaged M/E Companies (Mr. James Howard) to negotiate the acquisition with the landowner. Both a resolution and an ordinance setting forth the City's intent to appropriate were passed. A complaint to appropriate was filed on the Gorden property on July 11, 2008. An agreement to settle the case, however, was reached by the parties for a purchase price of three hundred sixty- five thousand dollars ($365,000). The case was dismissed on August 6, 2008. This ordinance serves to now authorize the City Manager to enter into a real estate purchase contract with the landowners.
