Cols,. 0, ~ ~JPS Form No, 6233-A Resolution N 0 'nni1..~_1..'!________nu_n NOV 5 1979 Passed nn__n __nn______._n._. ---.-____________n___19 ____n._ I RESOLUTION AUTHOFJZING THE CHIEF' EXECUTIVE OFFICER OF DUBLIN, OHIO, TO CONTRACT \UTH ~ THE BOARL OF COUNTY COl'lNISSIONERS, FRANK- L LIN COUNTY, OHIO, ON BEF.ALF OF THE VILIJ\.GE OF DUBLIN FOR THE INFLEMENTATION OF A RE- I HABILITATION AND INNOVATION GRANT PROGRAM I UNDER THE URBAN PARK AND RECREATION RECOV- ERY ACT (TITLE X, P.L. 95-625), AND TO PROVIDE SYSTEHATIC PLANNING SERVICES THERE- WITH. viIIEREAS, under the Urban Park and Recreation Recovery Act (Title X, F .L. 95- I 625), Franklin County, Ohio, is recognized by the United States Department of the Interior as an urban county, and therefore is entitled to apply and I compete for grants available from the said Act; and ~\lHEREAS, pursuant to the provisions of Section 307.85, Ohio Revised Code, the Board of County Commissioners of Franklin County, Ohio is authorized to part- icipate in and cooperate with cities and villages in Franklin County in est- ablishing and operating Federal prorrams; and WHEREAS, pursuant to the provisions of Section 307.15, Ohio Revised Code, , the Board of County Commissioners is authorized to enter into agreements with cities and villages in Franklin County whereby it is provided that the said Board of County Comnlissioners may exercise powers and perform functions or render services on behalf of the said cities or villages; ~ NOvi, THEREFCRE, BE IT RESOLVED BY THE COUNCIL OF CITY/VILLAGE. I SECTION 1. That the \'illage of Dublin is located within the geographical boundaries of Franklin County, Ohio. S.E;CTION 2. That the Chief Executive Officer of the Village is hereby author- ized and directed on behalf of village to enter into an agreement with the Board of County COmmissioners, Franklin County, Ohio, for the purpose of I making application for, and, if successful application is made, participatill€ I in the implementation of A RFHADILITATION AND INNOVATION GHANT PROGRAJ.'1 pur- I suant to Urban Park and Recreation Recove~! Act (Title X, P.L. 95-625), and I Section lc28.37, p. 47023, 44 Federal Register No. 1~5, 8/9/79. The agree- ment as provided herein is to be worded according to the draft identified as Exhibit IIA If which is attached hereto and made a part of this Resolution as if fully rewritten herein. .. SECTION 3. That the said agreement for which provisions are made in Section 2 hereof shall provide that pursuant to the provisions of Franklin County, Ohio, shall perform, through the Mid-Ohio Regional Planning Commission (HORPC) if necessary. SECTION 4. That this Resolution shall take effect and be in force from and after the earliest period allowed by law. COOPERATION AGREEMENT FOR REHABILITATION AND INNOVATION GRANT PROGRAM UNDER THE URBAN PARK AND RECREATION RECOVERY ACT (EXHIBIT A) () WHEREAS this Agreement, made concluded at Columbus, Ohio, this day of , 1979, by and between the Board of County Commissioners, Franklin County, Ohio, being duly au- thorized in the premises by the provisions of a Resolution adopted on , , 1979, hereinafter referred to as IL- ," '. "I4t'village of -Pul1~/AJ olll/) by +"c t:.uIIICtj its hAy6A. , or - being duly authorized in the premises by the provisions of Resolution/~ La No. dated , hereinafter referred to as II,,/Vi 11 agell: NOW, THEREFORE, it is hereby agreed by and between the parties hereto, upon the considerations herein set forth as follows: 1.) Board and ...,/Village will cooperate in the undertaking of, or assist in the undertaking of all steps necessary to make preapplication for and to apply for Urban Park and Recreation Recovery (UPARR) grants. Such steps shall include, but are not necessarily limited to, the notification of intent to apply for UPARR funding, which is to be sent to the areawide clearinghouse for the Ohio region, as well as the Heritage Conservation and Recreation Service (HCRS) regional office, in Ann Arbor, Michigan; and the filing of standard form 424 (Sf424) with the HCRS regional office. The above, and such other steps as are necessary to make preapplication and C application for such UPARR grants, shall all be done in accordance with the rules and regulations of the UPARR Rules and Regulations including but not limited to the Urban Park and Recreation Recovery Act (Title X, P.L. 95-625), and Section 1228.37, p. 47023, 44 Federal Register No. 155, 8/9/79, as well as all applicable provisions of the Ohio Revised Code. 2. ) Mid-Ohio Regional Planning Commission is authorized to act by Board and accepted by ...,/Village as agent of Board in planning, administrating, and overall coordinating the programs which are the subject of this agreement. 3. ) Assurances of Compliance SHALL BE executed and delivered by ...,/Village as the same may be modified from time to time to meet the UPARR Rules and Regulations, shall remain in effect and are hereby incorporated into and made a part of this agreement as if fully rewritten herein. NOW THEREFORE, the Board in consideration of the promises and agreements of lilt/Village herein set forth, hereby promises and agrees as follows: 1.) That it, or its agent, shall prepare the local portion of the INNOVATION/REHABILITATION PROGRAM based upon information it receives as to the needs, objectives, plans and proposals supplied by -..,/Village, or the CJ Chief Executive Officer thereof, pursuant to the applicable rules and regulations governing the UPARR program. 2. ) The Board assumes full responsibility, and all obligations for the preparation of the preapplication and application for the REHABlLITATION/ INNOVATION PROGRAM, and, if accepted, for the execution of that program, including, but not limited to, the overall analysis of needs, the setting of objectives, and the implementation of said plans and programs. 3. ) The Board shall prepare and submit to the appropriate area clearinghouse and regional HCRS office the REHABILITATION/INNOVATION GRANT preapplication, and, if necessary, REHABILITATION/INNOVATION GRANT application. # ,111 .-- AND THEREFORE, the ~/Village in consideration of the promises and agreements of Board herein set forth, hereby promises and agrees as follows: 1.) That it will promptly submit to Board needs, objectives, plans, and programs for preparation by Board of the local portion of the Recovery Action Program. D 2.) That construction activities outlined in the grant proposal will be limited to three years or three constructinn seasons, whichever is greater; and that the services and/or programs contained in the application be initiated within one year from the date of grant approval. 3. ) That facilities and services developed under this program offer recreation opportunities to the general public within the jurismictional boundaries of the ~/village. 4. ) That the applicant local government must demonstrate that it has adequate tenure and control of the land or facilities for which a rehabilitation or innovation grant is proposed. 5. ) That the ~/village will assume all responsibility for property assisted under UPARR for the continued delivery of recreation services as intended by the grant or for full compliance with the provisions of the grant agreement. 6. ) That no property improved or developed with assistance through the program shall be converted to other than public recreation use. 7. ) That the -*2f/village will assume the responsibility for keeping all UPARR assisted properties in reasonable repair to prevent undue deterioration and to encourage public use during reasonable hours and time of the year, (J according to the type of facility and intended uses. 8.~ That it will provide evidence of its commitment of thirty percent (30% of the matching funds required to implement its portion of the grant proposal.
