11-82 Resolution '" RECORD OF RESOLUTIONS ~' National Graphics Corp., Cols., O. ~ ~ Form No. 6233-A Resolution NO'__mU_~~_?mmm_mmn_ P assed____mn nmnnumU___ _m unumnn_m_19 h__un m A RESOLUTION REQUESTING THE OHIO LEGISLATURE TO GRANT TEMPORARY REAL ESTATE TAX DEFERMENT TO CERTAIN PERSONS WHEREAS, Franklin County, in compliance with State Law, has completed the re- quired sexennial reappraisal of real estate tax values; and WHEREAS, this reappraisal has often resulted in substantial, and sometimes con- fiscatory, increases in tax billings with little, or no, increase in the pro- perty owners ability to pay these taxes; and WHEREAS, this problem is particularly acute in areas such as Dublin where un- precedented development has impacted on old established central areas where families have occupied their homes for many years or even many generations; and I WHEREAS, the Village of Dublin has determined it to be sound public policy to preserve the character and nature of its central core area and specifically its historical mix of residential and commercial property; and WHEREAS, such preservation may be seriously inhibited by tax policy which re- quires residential property to be taxed at the rate at which the property D could be sold even though the residents are often elderly, on fixed incomes, who have no wish to sell during their lifetimes; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF DUBLIN, STATE OF OHIO, 7 of the elected members concurring: SECTION 1. That the legislature of the State of Ohio is hereby requested to enact the following provisions into law. a. When a citizen's principal place of residence is reappraised at a rate which would cause the basic tax assessment to be more than one-third (1/3) greater than the last previous basic assessment, I the citizen may elect to defer payment of the increase in excess of one-third (1/3) without penalty or interest. b. The amount of tax so deferred to become a lien against the pro- perty and to accumulate at the citizens option until the property I is sold or it ceases to be the principa1 residence of the citizen, his or her spouse or minor children. All deferred taxes to be J I immediately due and payable in the event of such change. c. Deferment of taxes to apply only to that portion of the tax in- t/ crease which is due to reappraisal or appraisal review. In- creases due to voter approved bonds, special utility assess- ments, etc., to not be considered for deferment. ~ SECTION 2. That the Mayor of Dublin, as Presiding Officer of the Council, pro- vide copies of this resolution to appropriate representative in the Ohio State Legislature and to use his good offices in all practical ways to secure early action by the legislature.
