Ordinance No. Passed 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION TO ACQUIRE A 0.077 ACRE, MORE OR LESS, PERMANENT EASEMENT, A 0.154 ACRE, MORE OR LESS, PERMANENT EASEMENT, AND A 0.329 ACRE, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM THE UNITED STATES POSTAL SERVICE, AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin ( "City") is constructing roadway improvements to widen Emerald Parkway between Tuttle Crossing; and WHEREAS, the United States Postal Service ( "USPS ") owns a parcel that the City must acquire property from in order to construct this sewer extension; and WHEREAS, the City and the USPS participated in discussions for the acquisition of this property and have come to mutually agreeable terms for the acquisition; and WHEREAS, the City desires to execute necessary conveyance documentation to complete the transaction between the City and the USPS. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring, that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire a 0.077 acre, more or less, permanent easement, a 0.154 acre, more or less, permanent easement, and a 0.329 acre, more or less, temporary construction easement from the USPS. Section 2. The USPS shall be compensated for the aforementioned property interests in the amount of Ninety -Five Thousand One Hundred Thirty Dollars ($95,130.00). Section 3 . This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The acquisition of the property interests described herein is necessary to conduct roadway construction to help alleviate traffic congestion and assist in pedestrian and vehicular safety. DATE: January 19, 2012 RE: Ordinance No. 04 -12 Emerald Widening Project — Tuttle Crossing Boulevard to Rings Road United States Postal Service PROJECT BACKGROUND The City of Dublin ( "Dublin ") is working in cooperation with the City of Columbus ( "Columbus ") to widen Emerald Parkway between Tuttle Crossing Boulevard and Rings Road (the "Project "). ACQUISITION INTRODUCTION: This memorandum discusses Ordinance No. 04 -12, which will allow the City Manager to execute necessary conveyance documentation to allow for the acquisition of property interests owned by the United States Postal Service ( "USPS ") in furtherance of the Project. Dublin needs certain property interests from the USPS in order to construct the Project, and have spent many months speaking with USPS representatives in order to obtain the needed property. Dublin initially sought a dedication/donation of the property. However, it is the USPS's policy not to donate property for roadway projects. The USPS sells its property interests like any private landowner would. Dublin appraised the property needed from the USPS for $85,680. Upon receipt of Dublin's appraisal report, the USPS demanded an additional $18,900 due to loss of green space, for a total of $104,580. Dublin, even after learning that the USPS does not typically donate property, attempted through all available channels to obtain a donation of the property. Dublin requested that Congressman Pat Tiberi's office call the USPS, and despite their best efforts, the Congressman's office was unable to make the USPS deviate from its standard. The USPS did, however, reduce their additional mordes demand by 50 %, and Dublin will be paying an additional $9,450 to the USPS above its appraised value.
