Fnrn No IMAM 7211 Ordinance No. Passed 1 20 AN ORDINANCE ACCEPTING THE DEDICATION OF RESERVE A, WATERFORD VILLAGE, PHASE 4, FROM THE FRANKLIN COUNTY SHERIFF'S DEED ON ORDER OF SALE, SAID PROPERTY LOCATED IN THE CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO WHEREAS, Reserve A of the Waterford Village subdivision, Phase 4 was originally platted in 1978 and the plat served to dedicate Reserve A to the City of Dublin (the "City'), the Reserve A being a portion of a Fire Department access between Monsarrat Drive and Pebble Creek Drive, as depicted in the attached Exhibit; and WHEREAS, based upon this information, and by request of the City, the Reserve was removed from the Franklin County Auditor's Tax Lien Sale under provisions of Chapter 5722 of the Ohio Revised Code, as the owner of record was listed as the now defunct Dublin Land Company; and WHEREAS, City representatives worked with officials of Franklin County in order to have title of Reserve A transferred to the City via a Sheriffs Deed on Order of Sale. NOW THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, of its elected members concurring, that: Section 1. The City is hereby authorized to accept the dedication of Reserve A, Waterford Village, Phase 4. Section 2 . It is necessary to transfer the title of Reserve A to the City to ensure the proper maintenance of the Fire Department access as a necessity for the public health and safety of the community. In November of 2008, City Council approved adoption of Ordinance 81 -08, a Land Bank Program according to the provisions of Chapter 5722 of the Ohio Revised Code (2008 legislation is attached for reference). The legislation allows the City to request the County Treasurer to remove certain properties from its list of tax lien (foreclosure) certificate sales when such properties may be necessary for the City's economic development projects or are needed for health and safety purposes. The City benefits from adoption of Chapter 5722 by having an approved process for the County to transfer clear title to the City's Land Bank. At the time of adoption of Ordinance 81 -08, staff presented properties that were requested to be removed from the County Treasurer's tax lien sale. One of these properties is located on Monsarrat Drive and the parcel was originally platted in 1978 as Reserve A in Waterford Village, Phase 4. The parcel connects to an adjacent City -owned Reserve on Pebble Creek Drive to form an access -way for the fire department. The Reserve on Monsarrat Drive was never transferred into the City's name and has remained in the Developer's name, the Dublin Land Company, which is now defunct. Although the two Reserves are currently functioning properly, obtaining title to the property ensures the property is well maintained by the City for the public health and safety of the community. The Reserve transferred to the City on November 1, 2011. The City will apply for tax exemption on the Reserve in January 2012 as allowed by the Ohio Revised Code. Staff regularly reviews Franklin County's list of tax lien certificate sales and monitors for parcels that may be of interest to the City. K =i11_1R1!Ll. Inc. 81-08 Ordinance No. Passed 20 AN ORDINANCE AUTHORIZING THE ADOPTION OF A LAND REUTILIZATION PROGRAM AND IMPLEMENTING THE PROVISIONS OF CHAPTER 5722 OF THE OHIO REVISED CODE WHEREAS, the Franklin County Treasurer has identified tax delinquent properties located in City of Dublin neighborhoods and has scheduled such properties to be included in a tax lien certificate sale; and WHEREAS, the City of Dublin desires to keep properties designated or platted as public land or public reserves from being sold in a tax lien certificate sale; and WHEREAS, the presence of such tax delinquent properties in a neighborhood may detract from community attractiveness and erode economic health and safety; and WHEREAS, provisions of Chapter 5722 of the Ohio Revised Code permit municipalities to adopt land reutilization programs and gain clear title to tax delinquent properties and also permit the City to hold and manage properties in a land inventory and/or sell the properties to bring them back to tax revenue producing use; and WHEREAS, in order for the City to employ the provisions of the Ohio Revised Code, Chapter 5722, City Council must adopt legislation to implement the provisions of this Chapter. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7 f the elected members concurring that: Section 1 . The existence of such tax delinquent properties scheduled for tax lien certificate sale has necessitated the City's implementation of a land reutilization program. Section 2 . The City hereby adopts the Land Reutilization Program as set forth in Chapter 5722 of the Ohio Revised Code. Section 3 . The City is hereby authorized and directed to utilize the provisions of Chapter 5722 of the Ohio Revised Code to obtain land through a sale, pursuant to a foreclosure proceeding initiated by the Treasurer of Franklin County (Section 5722.03 of the Ohio Revised Code and/or through a sale of forfeited lands by the Auditor of Franklin County in accordance with Section 5722.04 of the Ohio Revised Code) and/or conveyance in lieu of foreclosure in accordance with Section 5722.10 of the Ohio Revised Code. Section 4 . The City is hereby directed to facilitate the effective reutilization of nonproductive land situated within the boundaries of the City of Dublin and to foster the return of nonproductive, tax delinquent land to tax revenue generating status and/or devotion to public use. Section 5 . The Director of Finance is hereby authorized and directed to execute any and all necessary agreements in order to implement the Land Reutilization Program of the Ohio Revised Code Chapter 5722, and deliver certified copies of this Ordinance to the Franklin County Auditor, Treasurer, and Prosecutor. Background In September, the City received notification from the Franklin County Treasurer's Office of its annual delinquent tax lien sale on parcels in the County's portfolio (see letter attached). When a property owner has delinquent real estate taxes from the spring of the prior year and certain legal provisions are met, a tax lien on the property is issued by the County Treasurer and sold at a foreclosure auction as a tax lien certificate. The goal of the tax lien certificate sale is to collect delinquent property taxes owed to the County's school districts, agencies and local governments. Property owners are given sufficient notice prior to this action. Once the tax lien certificates are sold to an investor, the investor (lienholder) may foreclose on the property after one year if the taxes, interest and other penalties are not paid when due. As a courtesy, the County notified the City of the properties included in this year's tax lien certificate sale. Listed are public accessways on Monsarrat Drive and Beckley Lane. The Department of Finance asked the County Treasurer's Office to exclude both parcels from the tax lien sale. The County Treasurer's Office complied with our request and recommended the City adopt the provisions in Chapter 5722 of the Ohio Revised Code. • Monsarrat Drive Parcel This parcel was originally platted in 1978 as Reserve A in Waterford Village Phase 4. This parcel connects to another Reserve on Pebble Creek Drive to form a fire department access between the streets. The Pebble Creek Drive Reserve was dedicated to the City; however, the Monsarrat Drive Reserve was held in the name of the developer, the Dublin Land Company. (See information attached.) Beckley Lane Parcel This parcel was originally platted in 1978 as Reserve B in Waterford Village Phase S. It appears to have been planned as a walkway or accessway from Beckley Lane to St. Andrews. The parcel was not recorded correctly in 1978, and has now been "consumed" by the adjacent property owners with fencing and landscape. (See information attached) Chapter 5722 of the Ohio Revised Code (ORC) Chapter 5722 permits municipalities to adopt land reutilization programs and to gain clear title to unproductive tax delinquent properties. These properties may be held and managed by the City in its land inventory for their intended public purpose or marketed and sold to bring the properties back to a tax revenue producing use. The City benefits from adoption of Chapter 5722 by having a streamlined process for the County to transfer land to the City and expedite obtaining clear title. All lands acquired and held by the City pursuant to Chapter 5722 will be deemed real property used for public purpose and will be exempt from taxation. Recommendation Staff recommends approval of this Ordinance at the second readingipublic hearing on November 17, 2008.
