O. g-~ Resolution No. 16-84 Passed ___ __ ____________u___ ______ _____ _____u___19 u__u__ - - - --- -- - ---~ ---- DECLARING THE NECESSITY OF IMPROVING SHIER-RINGS [ ROAD AND PORTION OF WILCOX ROAD IN THE VILLAGE OF DUBLIN BY THE CONSTRUCTION OF WATER LINES AND APPURTENANCES AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of bublin, County of Franklin, State of Ohio, ~ of the elected members concurring: Section 1. Construct a twelve (12 ) inch water line on Shier-Rings Road from the intersection of Dublin Industrial Lane to Wilcox Road; thence northerly along the east side of Wilcox Road approximately 600 feet to a point; as shown on the plans hereinafter referred to, prepared by C. F. Bird & R. J. Bull, Ltd. , Consulting Engineers. It is hereby determined by this Council that the aforesaid streets to be improved as herein provided are so situated in relation to each other that in order to complete the improvement thereof in the most practical and economical manner, they should be improved at the same time, with the same kind of materials and in the same manner. Section 2. That the grade of said water improvements shall be the grade as shown by the engineer's plans and profiles which are made a part hereof. Section 3. That the plans, specifications, estimates, and profiles of [ the proposed improvements, heretofore prepared by the Engineer, and now on file in the Office of the Clerk are hereby approved. Section 4. That the entire cost of said improvement less the cost of intersections which shall be paid by the Village of Dublin, shall be assessed in proportion to the benefits upon all lots and lands bounding and abutting upon the proposed improvement between and including the termini of said improvement. The cost of said improvement sha 11 include the cost of preliminary and other surveys, plans, specifications, profiles, and estimates, and of printing, serving and publishing notices, resolutions and ordinances. The amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the interest thereon, the costs incurred in connection with the preparation, levy, and collection of the special assessments, expenses of legal services including obtaining an approving legal opinion, cost of labor, and material, and interest on bonds and notes issued in anticipation of the levy and collection of the special assessments together with all other necessary expenditures. Section 5. That the Engineer be and is hereby authorized and directed to prepare and file in the Office of the Clerk the estimated assessments of the cost of the improvement described in the Resolution. Such estimated assessments shall be based upon the estimate of cost of said improvement now on file in the Office of the Clerk and shall be prepared pursuant to the provision of this Resolution. When such estimated assessments have r been so filed, said Clerk shall cause notice of the adoption of the Resolution and the f il i ng 0 f said estimated assessments to be served on the ~ owners of all lots and lands to be assessed as provided in ORC S 727.13. Section 6. That the assessments to be levied shall be paid in 20 annual installments, with interest on deferred payments at the same rate as sha 11 be borne by the bonds to be issued in anticipation of the collection thereof; provided that the owner of any property assessed may, at his option, pay such assessment in cash within thirty (30) days after passage of the assessing Ordinance. ... That bonds of the Village shall be issued in anticipation of the collection of assessments by installments and in an amount equal thereto and notes of said Village shall be issued in anticipation of the issuance of such bonds and the levy of such assessments. Section 8. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, and safety of said Village, for the further reason that this water line construction has been petitioned by property owners desiring service as soon as possible and, therefore this Resolution shall take effect and be in force immediately upon its passage.
