A RESOLUTION AGREEING TO A
CHANGE IN THE BOUNDARY LINE
ALONG THE NORTH SIDE OF
TUTTLE CROSSING BOULEVARD
WEST OF FRANTZ ROAD, AND
DECLARING AN EMERGENCY
WHEREAS, the existing boundary is presently located within the right-of-
way of improved Tuttle Crossing Boulevard and along the south side of
Tuttle Crossing Boulevard; and,
WHEREAS, most of the existing right-of-way of Tuttle Crossing Boulevard
is in the City of Columbus; and,
WHEREAS, a boundary adjustment is necessary to cause the entire right-of-
way of Tuttle Crossing Boulevard to be in one governmental entity for
policing and maintenance purposes;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin,
State of Ohio, 6 of the elected members concurring:
Section 1. That Dublin agrees to adjust its municipal boundaries by
transferring 1.4~ acres of Tuttle Crossing Boulevard to the City of
Columbus, more fully described in Exhibit "A", which is incorporated herein
by reference.
Section 2. That this Resolution is hereby declared to be an emergency
measure necessary for the immediate preservation of the public peace,
health, safety and welfare, the reason for such emergency being the
necessity to forward the Resolution to the County Commissioners for
action; and provided it receives the affirmative vote of two-thirds of
the members of Council, it shall take effect immediately after passage
and approval by the Mayor; otherwise, it shall take effect and be in
force from and after the earliest period allowed by law.

DEANNEXATION OF 1.419 ACRES TO THE CITY OF COLUMBUS FROM THE CITY
OF DUBLIN LOCATED ON THE NORTH SIDE OF TUTTLE CROSSING BLVD.,
WEST OF FRANTZ ROAD
Being situated in the State of Ohio, County of Franklin,
City of Dublin and being 1.419 acres of which 0.723 acres (Or.
10895E11) and 0.297 acres (Or. 9271A13) is owned by the City of
Dublin, 0.310 acres out of 23.351 acres conveyed to Aetna Life
Insurance Company (Or. 9700A15) and 0.089 acres out of the
dedication plat of Frantz Road (PB. 61, PG. 73 ) , said 1.419 acres
being further described as follows;
Beginning at a common point on the boundary line between the
City of Columbus established by Columbus City Council (Ord. 924-
88) and recorded (Or. 11615B11), and by Dublin City Council (Ord.
34-87) and recorded (Or. 11495B12) both in the Franklin County
Recorders Office said point being in the east line of an 42.373
acre tract conveyed to Tuttle Road Limited Partnership (Or.
8958H10) and the west line of an 7.208 acre tract conveyed to the
Borror Corp. (Or. 8984D04) said point being located 50' north of
the centerline of Tuttle Crossing Blvd.;
Thence N 120 071 10" W, a distance of 20.00' to a point in
the north right-of-way line of Tuttle Crossing Blvd.;
Thence N 780 551 46" E, crossing of the said 7.208 acre
Borror tract; the 5.26 acre Borror tract and into Frantz Road,
with the said north right-of-way line, and being 70.00' north of
and parallel to the existing centerline of Tuttle Crossing Blvd.,
a distance of 871'i to a point in the said Frantz Road and being
on the east line of Frantz Road extended northerly as shown on
the dedication of Frantz Road (PB. 61, PG. 73 ) ;
Thence S 140 11' E, with the said extended east line of
Frantz Road, a distance of 40.00' to a point on the south
corporation line of the City of Dublin, Dublin City Council (Ord.

Thence S 780 55' 48" W, with the said south Dublin Corp.
line, a distance of 423' to a point;

Subject: Boundary Change - Tuttle Crossing Boulevard
As requested by Council, Staff has investigated the concern regarding the
placement of Columbus corporation signs within the right-of-way to be
transferred from Dublin to Columbus.
In discussing the matter with Columbus engineering staff, it was disclosed
that Columbus does not have a specific policy with regard to the placement of
corporation signs. They will place them where clearly there is a need to
identify the corporation line for maintenance or police patrol purposes. They
will also place the signs when it is requested by the community. It was
indicated that at present there were no plans to install signs at the subject
location.
Both the Columbus staff and the Dublin staff are in no position to say that
corporation signs mayor may not be needed in the future. If Tuttle Crossing
Boulevard is to be a Columbus maintenance and police responsibility, it may
require corporation signage in the future. I don't know of any mechanism
staff-to-staff that can prevent a sign if it is needed or requested. It is
also questionable that a public body could waive the right to place a uniform
traffic sign within the public right-of-way if it is needed or desired.
If Council desires the issue to be pursued further, it is recommended that the
city attorneys of both cities discuss legal mechanisms or that the Dublin
Council communicate their desires directly with the Columbus Council to see if
an agreement may be reached.

SUBJECT: Tuttle Crossing Boulevard Detachment
Please find attached a description of the Dublin portion of Tuttle Crossing
Boulevard. It is proposed that Dublin deannex the 1.4 acres to the City of
Columbus. The right-of-way in Franklin County will also be annexed to Dublin.
In addition to the letter from Columbus City Engineer, Robert Smith, I have
included a letter from Jim Musick that details Columbus' traffic signal plans.
Under the circumstances, I believe that all of the right-of-way of Tuttle
Crossing Boulevard should be in the City of Columbus and recommend approval of
the proposed deannexation. With your direction, I will prepare a Resolution
similar to the Resolution Council recently passed de annexing a small portion
of Sawmill Road.

Dear Mr. Bowman:
This letter concerns a telephone conversation that you had with
Steve Jewell of Traffic Engineering and Mike Merchant of
Engineering and Construction about transferring a portion of
Tuttle Crossing Boulevard to the City of Columbus. We have
prepared the annexation map and legal description as agreed to in
the telephone conversation. Enclosed are copies of both.
It is our understanding that the City of Dublin has no objection
to this proposed transfer. As you are aware, the City of Dublin
must pass legislation approving the transfer to the City of
Columbus. At such time the City of Columbus will accept the
transfer from the City of Dublin through Council action. Upon
City of Columbus Council approval, the matter will be forwarded
to the Franklin County Commissioners for action.
Should you have any questions concerning the above, please feel

SUBJECT: Tuttle Crossing Boulevard and Frantz Road Proposed
Annexation

As Council is aware, the City of Columbus has requested that the City
of Dublin agree to a boundary adjustment at the northwest corner of
Tuttle Crossing Boulevard and Frantz Road. The legislation approving
this request was tabled at a recent council meeting.
The purpose of this 1.4 acre boundary change would be to allow the
right-of-way to stay within the City of Columbus throughout this
stretch of highway and to provide for the proper maintenance and
control of the traffic signal which Columbus has recently installed at
this intersection. Our Planning and Development staff has recently
met with representatives from the Traffic Engineering Division of the
City of Columbus to cooperatively work on, and agree to, a proposed
alignment for Tuttle Crossing Boulevard as it extends west of 270 into
the proposed annexation areas. This has in fact produced a very
cooperative effort, with the City of Columbus agreeing to Dublin's
preferred alignment of this roadway. They further agreed that this
right-of-way would all be in Dublin.
It is the belief of Staff that, in order to maintain this positive
working relationship with the Columbus staff, Council should take
action to approve the proposed adjustment of this 1.4 acre tract to
the City of Columbus. Columbus staff has indicated to us that they
would do everything within their authority to prevent the installation
of misleading signage within the proposed annexation right-of-way.
We would recommend that Council take immediate action to approve this
proposed boundary adjustment to the City of Columbus as it is in the
best interests of both jurisdictions.
