O. ng~~~ Resolution No. 12-90 Passed 19 A RESOLUTION AGREEING TO A CHANGE IN THE BOUNDARY LINE ALONG THE NORTH SIDE OF TUTTLE CROSSING BOULEVARD WEST OF FRANTZ ROAD, AND DECLARING AN EMERGENCY WHEREAS, the existing boundary is presently located within the right-of- way of improved Tuttle Crossing Boulevard and along the south side of Tuttle Crossing Boulevard; and, WHEREAS, most of the existing right-of-way of Tuttle Crossing Boulevard is in the City of Columbus; and, WHEREAS, a boundary adjustment is necessary to cause the entire right-of- way of Tuttle Crossing Boulevard to be in one governmental entity for policing and maintenance purposes; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, 6 of the elected members concurring: Section 1. That Dublin agrees to adjust its municipal boundaries by transferring 1.4~ acres of Tuttle Crossing Boulevard to the City of Columbus, more fully described in Exhibit "A", which is incorporated herein by reference. Section 2. That this Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and welfare, the reason for such emergency being the necessity to forward the Resolution to the County Commissioners for action; and provided it receives the affirmative vote of two-thirds of the members of Council, it shall take effect immediately after passage and approval by the Mayor; otherwise, it shall take effect and be in force from and after the earliest period allowed by law. In discussing the matter with Columbus engineering staff, it was disclosed that Columbus does not have a specific policy with regard to the placement of corporation signs. They will place them where clearly there is a need to identify the corporation line for maintenance or police patrol purposes. They will also place the signs when it is requested by the community. It was indicated that at present there were no plans to install signs at the subject location. Both the Columbus staff and the Dublin staff are in no position to say that corporation signs mayor may not be needed in the future. If Tuttle Crossing Boulevard is to be a Columbus maintenance and police responsibility, it may require corporation signage in the future. I don't know of any mechanism staff-to-staff that can prevent a sign if it is needed or requested. It is also questionable that a public body could waive the right to place a uniform traffic sign within the public right-of-way if it is needed or desired. If Council desires the issue to be pursued further, it is recommended that the city attorneys of both cities discuss legal mechanisms or that the Dublin Council communicate their desires directly with the Columbus Council to see if an agreement may be reached. It is proposed that Dublin deannex the 1.4 acres to the City of Columbus. The right-of-way in Franklin County will also be annexed to Dublin. In addition to the letter from Columbus City Engineer, Robert Smith, I have included a letter from Jim Musick that details Columbus' traffic signal plans. Under the circumstances, I believe that all of the right-of-way of Tuttle Crossing Boulevard should be in the City of Columbus and recommend approval of the proposed deannexation. Hansley, City Manager ~ SUBJECT: Tuttle Crossing Boulevard and Frantz Road Proposed Annexation DATE: June 14, 1990 - . As Council is aware, the City of Columbus has requested that the City of Dublin agree to a boundary adjustment at the northwest corner of Tuttle Crossing Boulevard and Frantz Road. The legislation approving this request was tabled at a recent council meeting. The purpose of this 1.4 acre boundary change would be to allow the right-of-way to stay within the City of Columbus throughout this stretch of highway and to provide for the proper maintenance and control of the traffic signal which Columbus has recently installed at this intersection. Our Planning and Development staff has recently met with representatives from the Traffic Engineering Division of the City of Columbus to cooperatively work on, and agree to, a proposed alignment for Tuttle Crossing Boulevard as it extends west of 270 into the proposed annexation areas. This has in fact produced a very cooperative effort, with the City of Columbus agreeing to Dublin's preferred alignment of this roadway. They further agreed that this right-of-way would all be in Dublin. It is the belief of Staff that, in order to maintain this positive working relationship with the Columbus staff, Council should take action to approve the proposed adjustment of this 1.4 acre tract to the City of Columbus. Columbus staff has indicated to us that they would do everything within their authority to prevent the installation of misleading signage within the proposed annexation right-of-way. We would recommend that Council take immediate action to approve this proposed boundary adjustment to the City of Columbus as it is in the best interests of both jurisdictions.
