09-91 Resolution RECORD OF RESOLUTIONS Daylon Legal Blank C::1" i"arm No 30045 . ~,_....,_~~_ .u _. _ ____.___'M'_____.____.. ~_ n__________..___ ...___...__._ _ HC,)O!lIlioll ,\'0, 09-91 Passcc! 19 RESOLUTION OPPOSING THE PASSAGE OF H.B. 314 REGARDING THE ALLOCATION OF MUNICIPAL COURT OPERATING COSTS, AND DECLARING AN EMERGENCY '" WHEREAS , the City of Dublin currently pays a proportionate share of the operating cost for the Franklin County Municipal Court; and WHEREAS, the proportionate share currently may not exceed that which is disbursed by the clerk in costs, fees, fines, bailor other monies; and WHEREAS , the House Judiciary and Criminal Justice Committee are currently proposing to change the formula for allocating the costs of operating the Municipal Court among the cities and villages within the Courts Jurisdiction; and WHEREAS , one of the significant changes H,B, 314 introduces is to eliminate the "cap" on the amount that a participating municipality must pay: Le, the amount the Municipality actually gets back from the Municipal Court in fines, fees, forfeitures, etc,; and WHEREAS, the Mayor for the City of Dublin has already expressed concern to the Ohio Municipal League about said House Bill passing. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: SECTION l. THAT THE COUNCIL OF THE CITY OF DUBLIN OPPOSES H.B. 314 BECAUSE THE LEGISLATION: 1. Makes government less accessible to the public; 2, Would substantially increase legal costs; 3, Changes the formula for allocating the costs of operating a municipal court; 4, Allows the "cap" to be removed, thereby requiring cities and villages to pay an unfair share of operating costs, because residents already pay the costs through existing taxes, SECTION 2. That a copy of the Resolution be sent to the Speaker of the House Vern Riffe; Senator Ted Gray and State Representative William Schuck, SECTION 3.
