A RESOLUTION AUTHORIZING
THE CITY MANAGER TO ENTER
INTO A WATERLINE EXTENSION
AGREEMENT WITH SHEREX
CHEMICAL COMPANY
WHEREAS, on May 18, 1981, Sherex Chemical Company, Inc. and the Vi llage
of Dublin, Ohio entered into a Waterline Extension Agreement regarding
the construction, by Sherex Chemical Company, Inc. of a water main
project known as "12" Waterline in Frantz Road"; and
WHEREAS, the cost incurred by Sherex Chemical Company, Inc. for this
construction was $47,822.81; and
WHEREAS, Dublin agreed to assess all property owners abutting said water-
line who requested permission to tap a service connection to said
waterline, at an amount of $16.00 per front foot of property abutting
the waterline in addition to any other fees charged by Dublin for a tap
connection; and
WHEREAS, at the end of this ten-year Agreement, in the event that
Sherex's costs for constructing the waterline were not recouped, the
parties agreed to consider extending the term of the Agreement to
allow Sherex Checmical Company, Inc. additional time to recover its
costs.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, ~of the elected members concurring:
Section 1. That since to date, no additional property owners have tapped
a service connection to said waterline, and Sherex Chemical Company, Inc.
has not recovered any of its costs of the construction thereof.
Section 2. That, therefore, the parties hereby agree to extend the term
of the Agreement for an additional ten (10) year period with all other
terms and conditions thereof remaining unchanged and in full force and
effect.
Section 3. That this Resolution shall take effect and be in force from
and after the earliest period allowed by law.
