49-90 Resolution RECORD OF RESOLUTIONS - Dayton Legai B!onK Co i~orm No 30045 -.--"'''.....------.-.------------ -.-<-.., ......,,--....--.- ..---,._---~----_..,-, ,---_.._...,-,..,"""-". .- nCSO/ II t i [iii ,\'0, 49-90 Pussed 19 A RESOLUTION RATIFYING THE SIGNATURE OF THE DUBLIN CITY MANAGER ON THE DOCUMENT STATING THE FINAL FINDINGS AND ORDERS BY THE DIRECTOR OF THE OHIO EPA ON THE STANDARD CONNECTION BAN IMPOSED ON THE CITY OF DUBLIN, OHIO, AND DECLARING AN EMERGENCY WHEREAS, on March 7, 1990, the Director of the Ohio Environmental Protection Agency (EPA) issued Final Findings and Orders to the City of Dublin, imposing a standard connection ban. WHEREAS, the standard connection ban prohibited additional connections to or extensions of the sewerage system tributary to the pump station located at 6200 Dublin Road. WHEREAS, the standard connection ban covered the City of Dublin west of the Scioto River and any area outside the City of Dublin that is served by the pump station cited above. WHEREAS, the Director's Final Findings and Orders issued on March 7, 1990, ordered Dublin to make all efforts to eliminate overflows of raw sewage from the pump station cited at 6200 Dublin Road to the Scioto River. NOW, THEREFORE , BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, -L of the elected members concurring that: , Section 1. The City of Dublin complied with the Director's orders by: submitting a plan to reduce infiltration and inflow as well as submitting monthly progress reports on the results of the program; completing construction of a new pump station; obtaining and installing a telemetry system; installing ten permanent flow meters; retaining extensive con- sulting assistance as well as hiring four additional city personnel for the purpose of sewer system maintenance and purchase; and purchasing major capital equipment as well. Section 2. The Director's Final Findings and Orders issued and effective on March 7, 1990, were thereby revoked and the connection ban terminated by the Director of the Ohio EPA on September 14, 1990, pursuant to OAC 3745-11-04, said orders being to: not discharge more than 9.5 MGD through the new pump station until the telemetry system has been installed and is operational; completing its current testing and inspection program of areas of abnormally high infiltration and inflow by July, 1991; construct- ing a sewage detention basin to collect peak sewage flows that would exceed the capacity of the pump station unless Dublin can demonstrate that said basin is not needed; demonstrating the removal of two gallons of infiltration and inflow from the sewerage system for everyone gallon of wastewater from a new source connection to the system; submitting quarterly reports to the Central District Office of the Ohio EPA. Section 3. The Council of the City of Dublin ratifies the signature of the City Manager on the document of Final Findings and Orders, said signature being affixed on the 14th day of September, 1990. Section 4. That this Resolution be, and the same hereby is, declared to be an emergency measure for the preservation of the public peace, health and safety, and therefore this Resolution shall take effect and be in force immediately upon its passage.
