A RESOLUTION APPROVING THE FINAL DRAFT
SOLID WASTE MANAGEMENT PLAN FOR FRANKLIN COUNTY
WHEREAS, all municipal corporations and townships in Franklin
County voted to establish the Solid Waste Management Authority
of Central Ohio formally known as the Franklin County Regional
Solid Waste Management Authority; and
WHEREAS, the Franklin County Board of Commissioners
established the Solid Waste Authority of Central Ohio on June
6, 1989; and
WHEREAS, all solid waste management duties and
responsibilities of the Board of County Commissioners were
transferred to the Solid Waste Authority of Central Ohio Board
of Trustees; and
WHEREAS, in compliance with House Bill 592, the Solid Waste
Authority of Central Ohio has completed the draft Franklin
County Solid Waste Management Plan, submitted the plan to the
Director of the ohio Environmental Protection Agency for
preliminary review and comment; established a public comment
period; and held one public hearing concerning the draft plan;
and
WHEREAS, the Solid Waste Management Authority of Central Ohio
Board of Trustees, after consideration of comments and
recommendations received, made certain modifications to the
draft plan; has adopted the Franklin County Solid Waste
Management Plan; and has submitted to this legislative
authority a copy of the final draft plan and amendments to the
plan; and
WHEREAS, the City of Dublin is required by section 3734.55
O.R.C. to approve or disapprove the plan by resolution or
ordinance and deliver that resolution or ordinance to the
Solid Waste Authority within 90 days of receipt of the
Authority Board of Trustees adopted plan, and having been
requested to approve the final draft plan; and
WHEREAS, it is in the best interest of all persons in Franklin
County to approve the Franklin County Solid Waste Management
Plan.
NOW, THEREFORE, BE IT RESOLVED by Council of the City of
Dublin, State of Ohio, 7 members concurring that:
section 1. That the Franklin County Solid Waste Management
Plan adopted by the Solid Waste Authority Board of Trustees is
hereby approved.

section 2. That the Clerk of Council is hereby authorized and
directed to promptly deliver or cause to be delivered a
certified copy of this resolution of approval to the Board of
Trustees of the Solid Waste Authority of Central Ohio.

section 3. This Resolution shall take effect and be in force
from and after the earliest period allowed by law.

SUBJECT: Draft Solid Waste Management Plan
DATE: January 11, 1993
Attached is a Resolution in support of the Draft Solid Waste
Management Plan for Franklin County, as developed by the Solid
Waste Authority of Central Ohio and approved by its Board of
Trustees. Also included is a letter from Michael D. Long,
Executive Director of the Solid Waste Authority of Central Ohio.
Staff has monitored the development of this plan and is convinced
that it has been developed with the best interests of all Franklin
County residents in mind. Therefore, staff recommends passage of
this Resolution.
A copy of the draft plan is located in Council's conference room
for your review. I also wish to remind you that Council Member
King, as a Trustee of the regional authority, is most familiar with
the plan.

Dear Member of Council or Township Trustees:
Pursuant to Amended Sub. H.B. 592 the Solid Waste Authority of Central Ohio (the
Authority) developed a draft solid waste plan for our district. A copy of the plan was
distributed to you in late September. After the mailing, the Authority held a 30 day open
public comment period from September 20 through October 19 and conducted a public
hearing on November 3.
After comments were received during the open comment period and the public hearing, the
Board of Trustees adopted several plan amendments and by Resolution No. 71-92 (copy
attached) adopted the plan. The attached revised plan pages reflect those amendments and
can be easily inserted into your 3-ring binder that holds the plan. When updated with these
pages, you will have the complete plan.
In order to move forward on the plan approval process, we now need your Council or
Township Board of Trustees to take formal action within 90 days on this draft plan. Section
3734.55(B) ORC requires the following:
"Within ninety days after receiving a copy of the draft plan, each legislative
authority shall approve or disapprove the draft plan, by ordinance or
resolution, and mail or otherwise deliver a copy of the ordinance or resolution
to the committee."
After approval by legislative authorities representing at least 60% of the population of the
Authority, the plan can then be ratified by the Authority Board of Trustees and submitted
to the Ohio E.P.A for approval by the Director.
If the 60% approval is not attained, the Ohio E.P.A will prepare the Franklin County Solid
Waste Management Plan and will then order communities within Franklin County to
implement the plan as prepared by Ohio E.P.A.
