42-92 Resolution RECORD OF RESOLUTIONS Dayton legol Blank Co, Form No, 30045 -- -~-_._--_..,._--_._----_._---_. ..-- - --.__.__._.~.- - - - - _0..... ...____._.._.________.,___.__._____..,.________.______._...._..__._. ..'__ ~._-_._-----'-_._------~---------_.._.__._-_.-.,.._----..._- Re,<iO/ulioll SO. 42-92 Passed 19 A RESOLUTION REQUESTING APPROV AL TO SUBMIT TO THE STATE OF OHIO FOR '" "H-HAZARD USES" CERTIFICATION FOR PLAN REVIEW BY THE CITY OF DUBLIN DIVISION OF BUILDING INSPECTION WHEREAS, the City of Dublin has a Certified Building Division with state certification which does not currently include the ability to approye plans for "H"- Hazard Uses"; and WHEREAS, according to the Ohio Basic Building Code, Section 306.0 (4101:2-3-06) USE GROUP H, HIGH-HAZARD USES, 306.1 General: " All buildings and structures, or parts thereof, which are used for the manufacturing, processing, generation or storage of corrosive, highly toxic, oxidizing, pyrophoric, water reactive, highly combustible, flammable or explosive materials that constitute a high fire, explosive or health hazard, including loose combustible fibers, dust and unstable materials, shall be classified a Use Group H. "; and WHEREAS, seyeral technically-oriented clients within the City of Dublin require plan review under this particular classification currently necessitating submittal to the State of Ohio thereby delaying the review process and creating an unnecessary hardship to our client base; and .. WHEREAS, the Division of Building Inspection in consort with the Washington Township Fire Department and our commercial plans examiner are qualified to handle the technical aspects of "H" Uses permitting; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, 7 of the elected members concurring that: Section 1: The City of Dublin hereby requests the State of Ohio Board of Building Standards, pursuant to Section 3781.10 (E) of the Ohio Revised Code and Rules for Certification to extend the Certification of the City of Dublin to include "H-Hazard Uses". Section 2: That this Resolution be, and the same hereby is, declared to be an emergency measure for the preservation of the public peace, health and safety, and therefore this Resolution shall take effect and be in force immediately upon its passage. I was under the assumption that in the approval of the City of Dublin as a certified Building Department we were entitled to review all construction types. A recent review of the approved certified Departments shows that Dublin may examine all projects except use group "H". Ashland Chemical has certain areas in it that are use group "H", so do several other technical sites in the city. I believe our division in consort with the Washington Township Fire Department, our plans examiner and our Inspection Department are qualified to handle the technical aspects of "H" Occupancy permitting. On that basis, I have requested the State of Ohio to amend our application to permit the inclusion of "H" Hazard occupancies in our review process. without that amendment all applications for construction with companies such as Ashland Chemical in the "H" Use would have to go to the state of Ohio for review. This would be a unnecessary hardship to our client base. hazard.909
