Ordinance 53-11RECORD OF ORDINANCES Dayton Legal Blank Inc Ordinance No. 53 -11 Passed 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR HEALTH SERVICES WITH THE FRANKLIN COUNTY BOARD OF HEALTH FOR 2012 WHEREAS, Chapter 3709 of the Ohio Revised Code states that a city constitutes health district and must provide health services for residents within that district; and WHEREAS, the City contracts with the Franklin County Board of Health to provide health services as required by the Ohio Revised Codes; and WHEREAS, the previous contract authorized under Ordinance 35 -10 between the Franklin County Board of Health and the City of Dublin expires on December 31, 2011. NOW, THYREFORE, BE IT ORDAINED by the Council of the City ofDublin, State of Ohio, - (j - of the elected members concurring that: Section 1. The City of Dublin desires to enter into a contract, attached hereto as an Exhibit, with the Franklin County Board of Health to provide health services to the residents of the City of Dublin. Section 2. The City Manager and Finance Director be, and hereby are, authorized and directed to execute said contract with the Franklin County Board of Health. Section 3. Grigsby, City Manager DATE: September 22, 2011 Memo RE: Ordinance No. 53 -11 —Franklin County Board of Health 2012 Contract Summary Ordinance 53 -11 authorizes the City Manager to enter into a contract with the Franklin County Board of Health (FCBH) for the provision of public health services and plumbing inspection services for 2012. FCBH serves as the public health agency for the City, including the portions of the City in Delaware and Union Counties. The FCBH establishes a per capita rate for the public health services it provides to participating jurisdictions. Based on the 2010 U.S. census population for Dublin of 41,751 and the FCBH's 2012 per capita rate of $5.73, the City's cost for the 2012 contract is $239,233.23. This cost is the same per capita ($5.73) as for 2011; the cost increase for the contract reflects the updated population figures. As Council is aware, the mosquito control and management program is handled under a separate, three -year (2011 -2013) contract between Vector Disease Control Inc. and Franklin County Public Health. (Memo dated March 10, 2011 attached.) VDCI invoices the City of Dublin for the work completed under the contract. FCPH is responsible for the contract administration and monitors VDCI's performance and compliance with the terms, conditions and specifications to the contract. The estimated cost for the City of Dublin under the contract between FCPH and VDCI is 538,528.45 per year. Recommendation Staff recommends that Council approve Ordinance 53 -11 at the second reading/public hearing on October 10, 2011. Phone: 614 -410 -4400 • Fax: 614 - 410 -4490 Memo To: Members of Dublin City Council From: Marsha Grigsby, City Manager \Nt -- Date: March 10, 2011 Initiated By: Ron Burns, Director of Streets & Utilities Re: Mosquito Service Contract Summary Franklin County Public Health (FCPH) administered a public bid process for mosquito management and control on behalf of participating Franklin County member communities. As a result of this process, Vector Disease Control International, LLC (VDCI) was chosen as the contractor to provide mosquito management and control services for years 2011 through 2013. VDCI has provided mosquito management and control services for the City of Dublin through FCPH since 2008. VDCI's performance has been above satisfactory. Since 2008, Dublin's cost for mosquito services with VDCI was approximately $11,000 per year. Dublin's cost for the program in 2011 through 2013 will be $38,528.45 per year. The City budgeted $40,000 for services in 2011. Since 2008, FCPH heavily subsidized the cost of mosquito management and control services. FCPH will no longer subsidize the cost of the program and is passing along accepted bid cost to member communities, based on the desired level of service for each community. While this is an increase in cost, staff believes it is reflective of the cost of service to the City and that bulk purchasing has held costs to a competitive level. Staff estimates that the cost to provide this service, utilizing Dublin staff and equipment would be at least $46,000 per year. The FCPH mosquito program focuses on surveillance and prevention. The goat is to locate mosquito breeding sites and treat those areas with larvacide, thereby preventing larvae from becoming adult mosquitoes. Adult mosquito populations are monitored by traps designed to attract adult Culex mosquitoes. Culex mosquitoes are the species that carry and transmit West Nile Virus. Trapped mosquitoes are collected and tested for West Nile weekly. These mosquitoes are tested for West Nile Virus utilizing the RAMP test. This type of test provides results in 24-48 hours. Included in Dublin's cost for the program is additional RAMP testing above what is standard in the contract. Staff believes weekly RAMP testing of mosquitoes in each trap is important to make every effort to identify West Nile Virus in the area. In the event West Nile Virus is detected in a mosquito, it is likely adulticiding (fogging) will be utilized to reduce the adult mosquito population in the area. Additionally, trap data reveals the mosquito count and helps to both determine the effectiveness of the larvacide program and whether larvacide should be more aggressively applied. Dublin staff relies on the expert opinions of FCPH and VDCI regarding the use of adulticide. Adulticide is the least effective and least preferred method of controlling mosquito populations. Other than for Dublin's Fourth of July and Irish Festival events, it is highly unlikely adulticide will Memo re Mosquito Service Contract March 10, 2011 Page 2 of 2 be utilized unless West Nile Virus in mosquitoes is detected. Adulticide will not be utilized to control nuisance mosquitoes. Recommendation This report is provided for informational purposes only. For the third consecutive year, Franklin County Public Health is not requesting an increase in the per capita rate. We fully recognize the economic reality facing all of us at the local level. We continue to provide all of your required public health services while absorbing state and federal cuts. We are continually working to reduce our expenditures by freezing wages, delaying vehicle replacement, and other measures to assure the best use of the resources we have. Based on the per capital rate of $5.73 approved by the Franklin County Board of Health on August 9, 2011, the annual cost of your 2012 contract will be $239,233.23. Your total cost is determined by multiplying your city's population figures by the per capita rate. This population figure for your city is 41,751. Enclosed are three original contracts for your signature. Please sign and return all three contracts to the attention of Deidra Wolf. Please also include a copy of or link to the ordinance where your jurisdiction has adopted all Franklin County Public Health regulations. This contract is made and entered into by and between the City of Dublin, Ohio, a municipal corporation constituting a city health district, and the District Advisory Council of the Franklin County General Health District pursuant to Ohio Revised Code section 3709.08. WITNESSETH SECTION 1. The District Advisory Council of the Franklin County General Health District shall, for the consideration hereinafter stated, furnish to the City of Dublin, Ohio, and inhabitants thereof, all such public health services as are furnished by said Council to all villages and townships and the inhabitants thereof, of Franklin County, Ohio. Said services shall include the following Minimum Public Health Standards for Local Health Departments, as allowed by law according to the most current Ohio Administrative Code statutes: 3701 -36 -04 Protect people from disease and injury 3701 -36 -05 Monitor health status 3701 -36 -06 Assure a safe and healthy environment 3701 -36 -07 Promote healthy lifestyles 3701 -36 -08 Address the need for personal health services 3701 -36 -09 Administer the health district Also, the Franklin County General Health District shall provide other services, including the enforcement of the following Franklin County Public Health Regulations: (703) Plumbing (709) Rabies Control Regulation (710) Housing Maintenance and Occupancy (712) Rat Control (715) Dead Animals (716) Weeds (717) Manure (718) Nuisance (719) Approval of Building Plans (720) Household Sewage Treatment Systems (800) Comprehensive Solid Waste Regulations (803) Waste Haulers 2 Franklin County Public Health, if designated or authorized by the City's laws, codes or ordinances, will assist in the enforcement of Sections 519.09-519.11, Animal Control Ordinances. The City of Dublin, Ohio, shall adopt, according to law, the current version of the above - described regulations of Franklin County Public Health. Such services shall be rendered, if appropriate and necessary, when requested by the citizens of Dublin, Ohio, officials of city government, school authorities or medical personnel practicing in or around the City of Dublin, Ohio or when required by state statute. The City Attorney of Dublin, Ohio shall be responsible for any litigation involving enforcement of Health Regulations within the corporate limits of said political subdivision. This Agreement and any claims arising in any way out of this Agreement shall be governed by the laws of the State of Ohio. Any litigation arising out of or relating in any way to this Agreement or the performance hereunder shall be brought only in an Ohio court of competent jurisdiction in Franklin County, Ohio, and the City of Dublin hereby irrevocably consents to such jurisdiction. SECTION 2. Said public health services shall be furnished beginning January 1, 2012 and ending December 31, 2012 provided, however, that either party to this agreement shall have the right to cancel the same upon four (4) months written notice and the parties hereto may, by mutual written agreement, modify the terms of this agreement. SECTION 3. The Health Department shall render a report quarterly to the Mayor /City Manager on all services directly rendered to the citizens of Dublin. Such a report shall describe the type of service, where and for whom the service was rendered, and the number of cases, visits or other appropriate work units. SECTION 4. The City of Dublin, Ohio shall pay to the Franklin County General Health District for said public health services furnished to the City of Dublin, Ohio and the inhabitants thereof, such sum or sums of money based on a per capita rate as would be charged against municipal corporations composing the Franklin County General Health District at a per capita rate of $5.73. SECTION 5. Said sum or sums of money shall be paid by the said City of Dublin, Ohio to said Franklin County General Health District upon receipt of semi - annual 3 invoices by the Franklin County Board of Health on the first day of January, and June, 2012. The sum for 2012 shall not exceed $239,233.23, notwithstanding any fee established pursuant to the sections set forth below. SECTION 3 . In any instance where the Franklin County General Health District expends funds to abate a nuisance pursuant to Section 1, above, within the City of Dublin, Ohio, the Franklin County General Health District may invoice the City of Dublin, Ohio for the costs of such nuisance abatement. Further, the City of Dublin, Ohio, shall pay, in addition to those sums set forth in Section 5, above, to the Franklin County General Health District the cost to abate the nuisance. The Franklin County General Health District agrees to certify such nuisance abatement costs to the Franklin County Auditor to be recorded as a lien upon the property and shall reimburse all funds recovered under such a lien to the City of Dublin, Ohio. PLUMBING INSPECTION SERVICES: SECTION 7 . The District Advisory Council of the Franklin County General Health District shall, for the consideration hereinafter stated, furnish to the City of Dublin, Ohio, all plumbing inspections as are furnished to all inhabitants within the general health district of Franklin County. Inspectors are to be state certified by T he Ohio Department of Commerce. SECTION 8 . The City of Dublin, Ohio, through its Building Department, shall issue permits and collect fees for such plumbing inspections. The fee to be charged shall be the most current fee charged by the Franklin County General Health District, The City of Dublin, Ohio, shall forward sixty (60) percent of all plumbing inspection fees collected by them to the Franklin County General Health District after said Health District has submitted monthly statements of the amount due. The City of Dublin, Ohio shall pay said amount, within thirty (30) days after receipt of said statement. SECTION 9. This contract is approved by a majority of the members of the legislative authority of the City of Dublin, pursuant to the provisions of Ordinance dated SECTION 10. The City of Dublin, Ohio has determined that the District Advisory Council of the Franklin County General Health District is organized and equipped to adequately provide the service that is the subject of this contract. Pursuant to Ohio Revised Code section 3709.08, the Franklin County General Health District shall have all the powers and perform all the duties required of a board of health of the city health district within the jurisdiction of the City of Dublin. 4 IN WITNESS WHEREOF, the parties to this agreement have hereunto set their hands and seals and have executed this agreement the day and year written below.
