I; WHEREAS, the City of Dublin is preparing to extend Woerner

, Temple Road between Avery Road and wilcox Road and improve

'I related traffic circulation; and

; WHEREAS, said improvement will require the City of Dublin to

I obtain a fee simple interest in the attached Exhibits "A" and
I "B" located in the City of Dublin, Franklin County, Ohio.

I NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of
I
Dublin, State of Ohio, ~ of the elected members
concurring that:
Sectio~ Council considers it necessary and declares its
intention to appropriate, for the purpose of extending Woerner
Temple Road between Avery Road and wilcox Road and improving
related traffic circulation, a fee simple interest in and to
the premises located in the City of Dublin, Franklin County,
Ohio, and more fully described In the legal descriptions
attached hereto as Exhibits "A" and "B" .
Section 2. The City Manager is hereby authorized to cause
written notice of the passage of this Resolution to be served
upon the owners and persons In possession or having an
interest of record in the above-described property. This
notice shall be served according to law.
Section 3. This Resolution shall take effect and be In
force from and after the earliest date permitted by law.

DESCRIPTION OF ADDITIONAL RIGHT-OF-WAY FOR AVERY ROAD
Situated in the State of Ohio, County of Franklin, City of Dublin, and being part of a
0.683 acre tract conveyed to The Borror Corporation by deed of record in O.R. 26366
H01 of the Franklin County Recorder's Office, and being more particularly described as
follows:
Beginning at an iron pin found in the centerline of Avery Road at the
northwesterly comer of said 0.683 acre tract and the southwesterly comer of a
26.2186 acre tract conveyed to Donald & Betty Dearth by deed of record in O.R.
4053 F05, and being the true point of beginning of the tract described herein;
Thence N 860 36' 47" E, along the southerly line of said 26.2186 acre tract, 40.88
feet;
Thence S 040 00' 47" W, 16.23 feet to a point;
Thence with a curve to the left, having a delta of 010 00' 211/, a radius of 7579.50
feet, and a chord of S 030 30' 37" W, 133.04 feet to a point on the northerly line
of a 27.5 acre tract conveyed to The Borror Corporation by deed of record O.R.
26366 H03;
Thence S 860 36'021/ W, along said northerly line, 41.56 feet to said centerline of
Avery Road and the southwesterly comer of said 0.683 acre tract, said comer
being N 020 31' 58" E, 944.53 feet from Franklin County Monument 2211;
Thence N 02031' 581/ E, along said centerline of said Avery Road, 78.97 feet to
to a point at Franklin County Monument 7748;
Thence N 050 17' 151/ E, along said centerline, 70.44 feet to the true point of
beginning, containing 0.1424 acres, more or less, of which 0,1029 acres lie
within the existing right-of-way of Avery Road and being more particularly
delineated on the attached Exhibit B.
This description was prepared by Burgess & Niple, Limited, by S. Patrick Mills,
Professional Surveyor 7158 from an actual survey and available records in December,
1996 and January, 1997. The bearings are based on the bearing of S 5022' 07" E being
the easterly line of the recorded plat of Trinity Park Section Number 1 Subdivision, of

feet to a point;
Thence with a non tangent curve to the left, having a delta of 01015' 25", a radius
of 7579.50 feet, and a chord of S 02022' 40" W, 166.27 feet to the northerly line
of Sandy Comers, Section 1 of record in Plat Book 87, Page 98;
Thence S 890 59' 28" W, along said northerly line, 41.84 feet to a point in the
