CASE #ANX-01-98 WHEREAS, the Board of County Commissioners of Franklin County, Ohio, are presented the petition for annexation of certain adjacent territory to the City of Dublin, Ohio, filed by Dorothy Thomas, et aI., signed by Dorothy Thomas and Gary K. Moreland for National City Bank, Columbus, Trustee of the William Marvin Thomas Trust and appointing Christopher T. Cline, as agent for the said territory being described as follows: Real Estate situated in Washington Township of Franklin County, Ohio, in the Virginia Military Survey Number 3453, being a more particular description of the 107.338 acre tract (less the current right-of-way of Shier-Rings Road) of National City Bank, Trustee of the William Marvin Thomas Trust & Dorothy Thomas (Deed Reference 199706040014429) and being further bounded and described as follows: Beginning for reference at a Franklin County monument box found (FCGS 7752) at the centerline intersection of Eitennan Road (County Road 41) and Shier-Rings Road (County Road 42); Thence North 81 deg. 34' 43" East, 949.52 feet along said centerline of Shier-Rings Road to a railroad spike set at the northeast comer of the 16.158 acre tract of William K. WHEREAS, together with a map of said territory accompanying said petition filed with the Board of County Commissioners, Franklin County, Ohio, on January 2, 1998, be and the same are hereby filed in the Office of the County Auditor; WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that the County Commissioners can ask the County Engineer for a report on the accuracy of the map or plat; now, therefore, upon the motion of Commissioner Teater , seconded by Commissioner Stokes , BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY, OHIO: Section 1. That a hearing upon said petition shall be held in the County Commissioners' Hearing Room, 26th Floor of the Franklin County, Courthouse at 10:00 A.M. on March 4, 1998; and; Section 2. That the Zoning Director to the Board of County Commissioners be and hereby is directed to notify the agent of the petitioners of the time and place of said hearing; and Section 3. HUNTER, JR. AND FRANCIS L. HUNTER, LOCATED ON THE EAST SIDE OF DUBLIN CENTER DRIVE AND THE NORTH SIDE OF MARTIN ROAD, IN THE CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO. WHEREAS, the City of Dublin intends to improve Krier Drive, Dublin Center Drive and the Martin Road intersection; and WHEREAS, said improvement will require the City of Dublin to obtain a fee simple interest, in and to the premises described in the attached Exhibit "A" located in the City of Dublin, Franklin County, Ohio. NOW, THEREFORE, BE IT RESOLVEi/bY the Council, of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. Council considers it necessary and declares its intention to appropriate, for the purpose of improving Krier Drive, Dublin Center Drive and the Martin Road intersection, a fee simple interest in and to the premises located in the City of Dublin, Franklin County, Ohio, and more fully described in the legal description attached hereto as Exhibit "A". Section 2. The City Manager is hereby authorized to cause written notice of the passage of this Resolution to be served upon the owners and persons in possession or having an interest of record in the above-described property.
