Ordinance 52-11RECORD OF ORDINANCES Ordinance No. Inc. 52 -11 Passed . 20— AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION TO ACCEPT THE DEDICATION OF A 0.023 ACRES, MORE OR LESS, PERMANENT SIDEWALK EASEMENT, AND A 0.054 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION AND GRADING EASEMENT FROM WILLIAM G. ROBSON WHEREAS, the City of Dublin ( "City ") is preparing to construct its 2011 Street Maintenance — Phase 2 construction project ( "Project'); WHEREAS, said project requires that the City obtain certain property interests in Franklin County parcel no. 273- 000989, owned by William G. Robson; and WHEREAS, the William G. Robson is willing to dedicate the property interests in Franklin County parcel no. 273 - 000989 to the City as set forth in the legal descriptions attached hereto, and the City is willing to accept said dedication. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 4-- of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all documentation necessary to accept the dedication of an approximate 0.023 acres, more or less, permanent sidewalk easement, and a 0.054 acres, more or less, temporary construction and grading easement from William G. Robson, as set forth in the legal descriptions attached herewith. Section 2 . Robson 2011 Street Maintenance Program —Phase 2 PROJECT BACKGROUND: The City of Dublin ( "City ") is preparing to construct the 2011 Street Maintenance Program — Phase 2 construction project. The City must acquire property interests from various landowners located within the City in order to construct this roadway project. A representative of the City has reached out to landowners in order to gauge their respective interests in dedicating the needed property interests to the City. DONATION INTRODUCTION: William G. Robson is dedicating to Dublin the following property interests located within Franklin County Parcel No. 273- 000989, as visually depicted in the attached map: Property Interest Accepting ACRES 1. Permanent Sidewalk Easement 0.023 2. Temporary Construction and Grading Easement 0.054 ACTION TO BE AUTHORIZED BY ORDINANCE: Resolution No. 52 -11 would allow the City Manager to execute all necessary conveyance documentation to formally accept the dedication of the aforementioned property interests. RECOMMENDATION: Staff recommends approval of Ordinance No. 52 -11 at the second reading /public hearing on September 26, 2011 as obtaining the property interests described herein is necessary for the furtherance of the 2011 Street Maintenance Program — Phase 2 construction project.
