Ordinance 49-11RECORD OF ORDINANCES f -orm X,) :OOH; 49 -11 Passed 20_ LN ORDINANCE AUTHORIZING THE CITY MANAGER TO XECUTE NECESSARY CONVEYANCE DOCUMENTATION FOR THE ACQUISITION OF 5551 AVERY ROAD, WHICH CONSISTS OF A 0.667 ACRES, MORE OR LESS, FEE SIMPLE INTEREST, FROM MARY ANN MOORE WHEREAS, in the future, the City of Dublin ( "City ") plans to widen Avery Road, south of Woerner Temple Road; and WHEREAS, based upon the City's Preliminary Alignment Study, dated November 22, 1996, the future widening of 5551 Avery Road will require the City to acquire the property located at 5551 Avery Road; and WHEREAS, the property owner approached the City to inquire if the City would be interested in acquiring her property located at 5551 Avery Road, Franklin County Parcel No. 273- 000073; and WHEREAS, the City and the property owner participated in discussions for the acquisition of her property; and WHEREAS, the City and the property owner have come to mutually agreeable terms for the acquisition of her property; and WHEREAS, the City desires to execute necessary conveyance documentation to acquire 5551 Avery Road. NOW, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire 5551 Avery Road, a 0.667 acres, more or less, fee simple interest from Ms. Mary Ann Moore. Section 2. Ms. Moore shall be compensated for the aforementioned property interests in the amount of Ninety Five Thousand Three Hundred Twenty Five Dollars ($95,325.00). Section 3 . Haque DATE: September 8, 2011 RE: Ordinance 49 -11 Mary Ann Moore 5551 Avery Road PROJECT BACKGROUND: The City of Dublin ( "City ") has future plans to widen and improve Avery Road. Based upon the Preliminary Alignment Study dated November 22, 1996, the future alignment of the widened Avery Road will require the City to acquire the property at 5551 Avery Road ( "Property"). Ms. Mary Ann Moore owns the Property and recently contacted the City to express her desire to sell the Property to the City in anticipation of the project. The City and Ms. Moore entered into negotiations and Ms. Moore agreed to sell the Property to the City for the City's appraised value. ACQUISITION DETAILS: The City has successfully negotiated a land sale transaction with Ms. Mary Ann Moore for her property located at 5551 Avery Road (Franklin County Parcel No. 273 - 00073). The map attached to Us memorandum depicts the property being acquired. Again, the City is acquiring the property for the City's appraised value. In total, the acquisition consists of the following property interests: Property Interest Acquiring ACRES COST 1. Fee Simple Parcel No. 273- 000073 0.667 $ 95,325 TOTAL COMPENSATION $ 95,325 ACTION TO BE AUTHORIZED BY ORDINANCE: Ordinance No. 49 -11 would allow the City Manager to execute all necessary conveyance documentation to formally acquire the aforementioned property interests. RECOMMENDATION: Staff recommends approval of Ordinance No. 49 -11 at the second reading /public hearing on September 26, 2011, as the acquisition of these property interests will further future public roadway improvements on Avery Road.
