RECORD OF RESOLUTIONS Day tan Legal Blonk Co, Form No. 30045 --..------ Resolution No. 08-95 Passed _19____ A RESOLUTION TO SET FORTH A STATEMENT OF SERVICES TO BE PROVIDED TO THE AREA IN A PROPOSED ANNEXATION OF 21+/- ACRES FROM JEROME TOWNSHIP, UNION COUNTY TO THE CITY OF DUBLIN, OHIO AS REQUIRED BY SECTION 709.031 OF THE OHIO REVISED CODE, AND DECLARING AN EMERGENCY. WHEREAS, a petition for the annexation of 21+/- acres from Jerome Township was duly filed by David E. Haid on March 3, 1995 on behalf of Walter L. Starkey, 6503 Cook Road, Powell, Ohio and James P. and Lillian S. Edwards, 7041 Mitchell Dewitt Road, Plain city, Ohio; and WHEREAS, a public hearing has been scheduled before the Union County commissioners on Monday, May 8, 1995 at 10:30 a.m.; and WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to said hearing, the Municipal Authority shall adopt a statement indicating what services, if any, the Municipal corporation will provide to the territory proposed for annexation; and WHEREAS, Dublin city Council adopted an interim annexation policy on June 20, 1994 to provide policy directive regarding proposed annexations to the city of Dublin. NOW, THEREFORE, BE IT RESOL{;D by Council of the city of Dublin, state of Ohio, of the elected members concurring: Section 1. The city of Dublin will provide the following municipal services for the 21+/-acres in Jerome TownShip, Union County upon the annexation of said area to the city of Dublin, Ohio: Police. The City provides Police and Communications service on a full twenty-four hour basis and also has mutual aid agreements with other municipalities. The annexation area lies approximately two miles northwest of Dublin's Police Division Headquarters. Dublin operates with a minimum of four cruisers on duty. A response time of approximately five minutes for an emergency situation should be expected for this area. Fire. Fire and emergency medical services protection is currently provided by well-staffed departments in Jerome, Washington and Perry Townships. They, too, have mutual aid agreements with other municipalities. This annexation would not change fire department jurisdictional boundaries, and therefore response times for fire and emergency medical services will not be affected. The Jerome Township Fire station is approximately six miles from the annexation area and normal response times should be approximately eight minutes. However, due to an existing automatic response agreement, the area is also served by the Washington Township Fire station 93 which is located approximately 1.0 mile away, and normal response time would be approximately three minutes. Sanitation. Residential refuse collection services are contracted by the city and are currently provided at no additional charge. Hansley, City Manager DATE: April 4, 1995 SUBJECT: Annexation Request: Resolution #08-95 (21 acre Starkey tract - Union County) INITIATED BY: Terry D. Foegler, Asst. City Mgr.lDir. of Dev, Council is being requested to approve its standard statement of services for the proposed annexation of this 21 acre tract, located in Union County, currently owned by W. L. Starkey. The public hearing for this petition will be held by the Union County Commissioners on Monday, May 8, 1995 at 10:30 a.m. If approved by the Union County Commissioners, the annexation request will be back before City Council, who may either approve or disapprove the petition at that time. The site in question encompasses approximately 21 acres and is located immediately west of the City of Dublin/Franklin County Line, and is bounded by Brand Road (Mitchell & DeWitt Road) on the north. The tract is under common ownership with a much larger 145 acre parcel located within the City of Dublin, immediately east of the subject site, also owned by Walter Starkey. In the process of reviewing the initial submission of this petition, staff discovered an error which required that the process be re-initiated. Specifically, the petition indicated Mr. Starkey as the owner of the entire tract being annexed, while a .87 acre piece of the annexation area is owned by James P. and Lillian S. Edwards. The revised petition now includes the signatures of Mr. and Mrs. Edwards. The proposed petition is consistent with the City's recently adopted Interim Annexation Policy which provides for allowing such annexations when property under common ownership is split by a county boundary. The policy does, however, note that each case must be looked at individually in order to fully determine our ability to provide sewer and water to the property. Please note the attached memorandum to Balbir Kindra from Chuck Petty indicating that the subject property is fully serviceable with City sewer and water facilities. Also, as can be seen on the attached map, the western boundary of the subject parcels does align with two other recent annexations accepted by the City. Obviously, the issues of "jurisdictional fragmentation" among the various private utilities, as outlined in the Interim Annexation Policy, confront this parcel as well. ~ . ;. Kindra, City Engineer CC: Terry Foegler From: Chuck Petty Date: February 3, 1995 Subject: Annexation Request - 21 acre tract - Walter Starkey The subject tract is in Union County and abuts other l~ds owned by Mr. Starkey that are within the City of Dublin. These properties are within the tributary boundaries defined by Muirfield Drive and A very Road Sanitary Sewer Study prepared by Bd&M recently. Sanitary sewer service will be available to these properties once the proposed Shannon Glen sewers and the sewers across the Erwin tract are constructed. These sewers are tributary to the North Fork of Indian Run Trunk Sewer which has been identified as having future capacity problems. These problems will not manifest themselves until the majority of the tributary area is developed. Since development is currently light in this tributary area, capacity problems can be dealt with in the future by adjusting the tributary boundaries. Water service will be extended west along the North side of Brand Road as part of the Shannon Glen subdivision. This will be the point at which water service to the subject tract of land can be accessed. JEROME TOWNSHIP - DAVID E. HAID. AGENT FOR PETITIONER A motion was made by Glenn W. Irwin and seconded by Don Fraser to adopt the following resolution: WHEREAS, David E. Haid, Agent for Petitioners in the matter of Annexation to the City of Dublin of 21 acres, received by this board in Resolution No.1 04-95, Commissioners Journal No. 41, Page 60, dated March 6, 1995; AND WHEREAS, said agent, David Haid, advertised this petition for four consecutive weeks as required by Section 709.02 of the Ohio Revised Code, but failed to include the time, date and place of the hearing which was scheduled for May 8, 1995 at 10:30 a.m. in the Commissioners Hearing Room, 233 West 6th Street, Marysville, Ohio; AND WHEREAS, Agent Haid has been advised ofthe insufficiencies of the published legal notice and has agreed to re-advertise said petition to meet all requirements of the law; NOW, THEREFORE, BE IT RESOLVED, that the date for the public hearing on the subject petition is changed to May 30, 1995 at 10:30 a.m. in the Commissioners Hearing Room, 233 West 6th Street, Marysville, Ohio, this new date still being in the statutory time period of 60-90 days following the filing of the petition.
