I A RESOLUTION AUTHORIZING THE CITY MANAGER

TO CONVEY AN EASEMENT AND RIGHT-OF-WAY TO
COLUMBIA GAS OF OHIO, INC., WHICH WILL
UPGRADE SERVICE AT THE
PAUL G. BLAZER MEMORIAL P ARKW A YI
RINGS ROAD INTERSECTION
WHEREAS, the City of Dublin has been asked to dedicate an easement to Columbia Gas of
Ohio, Inc., the details of which are more fully set forth in the attached document; and

I WHEREAS, the City Engineer of the City of Dublin has determined that the Easement and
I
I
I Right-of- Way instrument prepared by Columbia Gas of Ohio, Inc. is satisfactory; and
I
I
WHEREAS, the Easement will upgrade the existing gas service to major commercial users in
I
I Dublin; and
I
I WHEREAS, the gas company will minimize any potential impact to existing landscaping and
I
I replace to the City's satisfaction any landscaping damaged during installation.

I
I NOW, THEREFORE, BE IT RESOLVED by Council of the City of Dublin, State of Ohio,
I 7 of the elected members concurring that:

I Section 1. The City Manager be and hereby is authorized to execute on behalf of the City
i
I of Dublin the deed of easement attached hereto as Exhibit A and incorporated herein by
I reference to the Columbia Gas of Ohio, Inc. to service Paul G. Blazer Memorial Parkway from
I Rings Road to the Rings Road Water Tank, all as more fully described in the said easement
instrument attached hereto.
Section 2. That the City Engineer be, and hereby is directed to have the Easement and Right-
of- Way instrument recorded at the Franklin County Recorders office.

I Section 3. That this Resolution shall take effect on the earliest date allowed by law.

Ihe limits of a tt'lirty (30) foot wide eaaement, said easement Is south of parallel and adjacent to the south
right of way line 01 Rings Road AND a thirty (30) foot wide epsement east of parallel and adjacent 10 the
east rlghl of way line of Paul Blazer Parkway, as shown on EXHIBIT "A" attached hereto and made a part
hereof.

In the event the Grantor 6houlci ever deem it necessary that all of part or the Company's pipeline
. needs tD be relocated to accommodate future Rings Road improvements, the Company will at i18 own
expense r810cate its pipsline to a new location, mutually acceptable to bolll parities. The Grantor shall
furnish the Company. at no COtit such a valid easement as It may require for the relocation of its pipeline.
With the right of Ingress and egress to and from the same, the Grantor may fully use and enjoy
lh19 said premises, except for the pllrposes hereinbefore granted 10 the said Company and will not In any
way impair the ability of the Company 10 operale, Illalntain. repair. replace or remove any suell facility.
All pIpes shall be buried so as not to IIllenere with the present use of the land.
The Company shall replace and restore the area disturbed by the laying, construclion, operatlon
and maintenance of said pIpelines to as near as praoticalto its originsl conditiOn.
The Grantor and the Company have agreed as a part of the consideration hereof that any
demages to lawn, drIveways, Shrubbery, draIn tiles, tr~es, crops or fences on said premIses, the amount
. of which cannot be mutually agreed upon. shall be determIned by a panel of arbitrators composed or three
disinterested persons, of whom the Grantor and the Company shall appoint one each and the two
arbitrators 80 appointed shelllppolnt the third, the award of any lwo of whom shall be final ~nd i) condition
precedent to the Instltullon of anv legal proCeedings hereunder,
The Company shall indemnify and hold harmless the Grantor and all of its agents. employees
and/or repreSentalives from and against all claims, damages, losses, suils and aClions; Including
attorney's faes, arisIng or resulting from Ihe Installallon. oonstruction. operation, maintenance. repair,
renewal, replacement or removal of said pipelines on, over, Under and across said premises, unless
caused by the negligence or willful miscondlJcl of the Granto~, lis agenls, employees andlor
representatives.
The Grantor warrants thai. to the best of its knowledge, the lands encompassed by this easement
have not been used as P dump sito and contain no substances or malerlals which if dlstllrbed Would
cause or threaten to cause impairment to human heallh or tile environment.

Re: Resolution for Granting Columbia Gas an Easement
Attached is a resolution authorizing the City Manager to execute a deed of easement with Columbia
Gas of Ohio, Inc. The easement requested is on the south side of Rings Road adjacent to Paul G.
Blazer Memorial Parkway as shown on attached Exhibit "A". This easement will enable the gas
company to upgrade existing gas service to current and new major commercial users in the Paul G.
Blazer Memorial Parkway and Rings Road intersection area before winter.

Columbia Gas of Ohio, Inc, has contracted with the Fishel Company to acquire private
right-of-way from the City of Dublin as shown on Exhibit "A" for Deed Ref. 0, R. 18639
H-07.
