WHEREAS, the City of Dublin is preparing to improve the Shier-
I Rings Road and Avery Road intersection; and
WHEREAS, said improvement will require the City of Dublin to
obtain a temporary construction easement, in and to the
premises described in the attached Exhibit "AU located in the
City of Dublin, Franklin County, Ohio.
NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of
Dublin, State of Ohio, ,7 of the elected members
concurring that:
Section 1. Council considers it necessary and declares its
intention to appropriate, for the purpose of improving the
Shier-Rings Road and Avery Road intersection, a temporary
construction easement in and to the premises located in the
City of Dublin, Franklin County, Ohio, and more fully
described in the legal description attached hereto as Exhibit
"A" .
Section 2. The City Manager is hereby authorized to cause
written notice of the passage of this Resolution to be served
upon the owners and persons in possession or having an
interest of record ln the above-described property. This
notice shall be served according to law.
Section 3, This Resolution shall take effect and be in
force from and after the earliest date permitted by law.

Description of Temporary Easement for Grading
Situated in the State of Ohio, County of Franklin, City of Dublin and part of Virginia Military
Survey 3004 and being 0.005 acre out ofa 2.977 acres parcel conveyed to Patricia H. King and
Joseph B. King (Co-Trustees), as recorded in OR 30292 FI0 in the Franklin County Recorder's
Office, and being more particularly described as follows:
Beginning at an iron pin found at the Grantor's southeasterly comer in the westerly right of way
line of Old Avery Road and being 138.97 feet left of Station 22+10.99 in the centerline of survey
of Avery Road as delineated on the Centerline Plat for the improvement to Avery Road and Shier-
Rings Road of record in Franklin County, being the TRUE POINT OF BEGINNING of the
easement being described;
thence leaving said point with the Grantor's southerly line, South 84 degrees 13 minutes 37
seconds West a distance 17.81 feet to a point;
thence leaving said property line with the westerly line of this tract, North 32 degrees 37 minutes
57 seconds East, a distance of29.69 feet to a point in the above mentioned westerly right of way
line of Old Avery Road;
thence with said line, South 04 degrees 11 minutes 50 seconds East, a distance of23.28 feet to
the TRUE POINT OF BEGINNING, said described tract containing 0.005 acre, more or less.
The above described acreage is contained in Auditor's Parcel 273-000327.
Stations and offsets used in this description are referenced to the proposed centerline of Avery
Road as appears on the Centerline Plat For the improvement of Avery and Shier-Rings Roads
prepared by URSGreiner, and of record in Franklin County.
Bearings used in this description are based on an actual field survey utilizing Franklin County
Monuments Nos. FCGS 5536 and FCGS 7752 by URSGreiner in June 1996.
This description was prepared for URSGreiner by Roger M. Smith, P,S. 6899 from existing
records and actual field survey.
