AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
EXECUTE NECESSARY CONVEYANCE DOCUMENTATION
FOR THE ACQUISITION OF 0.480 ACRES, MORE OR LESS,
FEE SIMPLE INTEREST FROM JOHN T. BYERS, AND
DECLARING AN EMERGENCY
WHEREAS, the City of Dublin ( "City ") is preparing to extend sewer to the City's job
ready site with includes the City -owned property at Houchard Road and State Route
161; and
WHEREAS, John T. Byers ( "Byers ") owns a parcel that the City must acquire
property from in order to construct this sewer extension; and
WHEREAS, the City and Byers participated in discussions for the acquisition of this
property from Byers, and have come to mutually agreeable terms for the acquisition;
and
WHEREAS, the City desires to execute necessary conveyance documentation to
complete the transaction between the City and Byers.
NOW THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, -7-- of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute all necessary
conveyance documentation to acquire a 0.480 acres, more or less, fee simple interest
from Byers.
Section 2. Byers shall be compensated for the aforementioned property interests in
the amount of Fifty Thousand Dollars ($50,000.00).
Section 3 . This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare and for the further reason
that emergency action is necessary in order to have the improvements substantially
complete by the end of the year in accordance with the grant requirements of the Ohio
Job Ready Sites Program. This ordinance shall therefore be effective upon passage.

The City of Dublin ( "City ") is extending sewer to the City's Job Ready Site, which includes the City -
owned property at Houchard Road and State Route 161. The City must acquire sewer easements or
necessary property in fee simple from landowners in this area in order to successfully extend the City's
sewer system. The property that is the subject of this Ordinance is owned by John T. Byers ( "Byers ")
and is located in an unincorporated area of Washington Township, just outside of the City's corporation
limits at 6800 Cosgray Road.
ACQUISITION INTRODUCTION:
City representatives successfully negotiated the acquisition of a fee simple interest from Byers. These
property interests me generally depicted in the map attached to this memorandum.
In total, the acquisition consists of the following:

Byers may also desire to annex into the City so that Byers can benefit from this sewer extension, and
this process will he handled via separate ordinance and process.
ACTION TO BE AUTHORIZED BY ORDINANCE:
Ordinance 43 -11 would allow the City Manager to execute all necessary conveyance documentation to
formally acquire the aforementioned property interest.
RECOMMENDATION:
In order to have the improvements substantially complete by the end of the year in accordance with the
grant requirements of the Ohio Job Ready Sites Program, staff recommends approval of Ordinance 43-
11 by emergency at the second reading/public hearing on August 22, 2011.
