04-97 Resolution RECORD OF RESOLUTIONS Dayton Legal Blank Co, Farm No. 30045 I' i II i --c~~~~- flew!lItio" No. I Passed 19u i 04~97 I I 1 I I I I I I, I A RESOLUTION AUTHORIZING THE CITY MANAGER I I TO SIGN A COOPERATIVE AGREEMENT BETWEEN I FRANKLIN COUNTY AND THE CITY OF DUBLIN, OHIO \ FOR IMPROVEMENT OF TUTTLE CROSSING BOULEVARD I BETWEEN OLD WILCOX ROAD AND BRITTON PARKWAY , I WHEREAS, the City of Dublin has, through the Tuttle Crossing Feasibility Study, identified I I Tuttle Crossing Boulevard is in need of road widening ; and WHEREAS, the City of Dublin has identified Tuttle Crossing Boulevard widening as one of the top priority projects in the Southwest Area Plan; and WHEREAS, the City of Dublin has further recognized the need to widen Tuttle Crossing Boulevard in connection with the approval of the Tuttle West Master Plan; and WHEREAS, the Franklin County Engineer is participating in the project to improve Tuttle Crossing Boulevard between Old Wilcox Road and Britton Parkway; and WHEREAS, the Franklin County will prepare construction and right-of-way plans and will award and administer the construction contract and provide project inspection; and WHEREAS, it is in the best interest of both governmental units to design and construct projects in a cooperative manner; WHEREAS, Franklin County has passed Resolution No. 27 - 9 7declaring the improvement of 1\lttle Crossing Boulevard, between Old Wilcox Road and Britton Parkway, necessary and has authorized the County Engineer to enter into an agreement with the City of Dublin to complete the improvement; and WHEREAS, Ohio Revised Code 5557,02 requires that the consent of the City as evidenced hy proper action of its legislative authority entered upon its records be first ohtained before the County can proceed with the improvement. NOW, THEREFORE, BE IT RESOLVED by the Coun::il of the City of Dublin, State of Ohio, 2- of the elected members concurring that: Section 1. That it is declared to be in the public interest that consent of the City be and such consent is hereby given to the County to design and construct the proposed improvement in accordance with approved plans, specifications and estimate consistent with the Tuttle Crossing Feasibility Study and City of Dublin standards. Section 2. The City Manager be and hereby is authorized to execute on behalf of the City of Dublin the Cooperative Agreement between Franklin County and the City of Dublin, attached hereto as Exhibit 1. Section 3. That the City Manager or his designee be, and hereby is, authorized to cooperate with the Franklin County Engineer as outlined in Exhibit 1. Section 4. That this Resolution shall take effect and be in force from and after the earliest period allowed by law. Oh;, FRANKLIN COUNTY WILL: * Declare the improvement necessary, and agree to participate with the City of Dublin for the year 1999 construction. * Select, compensate, manage and direct an engineering consultant in the preparation of detailed right-of-way and construction plans in accordance with the recommendations of the Tuttle Crossing Boulevard Feasibility Study for a four-lane boulevard street with curb and gutter, street lights, bikepath, sidewalk and traffic signals where recommended and warranted in accordance with the City of Dublin design standards. * Provide preliminary Line, Grade and Typical plans, final construction and right-of-way plans consistent with the City's design standards for Dublin's review and comments. * Apply for any necessary Environmental Protection Agency and other permits. * Franklin County Commissioner will hold a public hearing on and approve final construction plans. * Coordinate any necessary private utility relocation and/or adjustments. * Prepare bid documents, advertise for, take bids, award and administer the construction contract and compensate contractor for construction costs. * Responsible for costs of the four-lane boulevard. * Pay for construction costs of the four-lane boulevard road. * Provide for construction engineering inspection and "as built" plans at the County's expense. * Settle any contractor claims due to private utility relocation delays, * Coordinate maintenance of traffic with the City and "Paving the Way". WHEREAS, the Tuttle Crossing Boulevard has utility to the general public of Franklin County, as well as the citizens of the City of Dublin, and WHEREAS, Franklin County has passed Resolution No. 27-Cf7 declaring the widening of Tuttle Crossing necessary and authorizing the County Engineer to enter into any agreements with Dublin necessary to complete the improvement. WHEREAS, Tuttle Crossing Boulevard is an important link between the County and City highway system for through traffic, and WHEREAS, the City of Dublin has passed Resolution No, 04-Cf7 , authorizing its City Manager to enter into a cooperative agreement with Franklin County for improvement of Tuttle Crossing Boulevard, NOW TIIEREFORE, tre City of Dublin (tre City) through its City Manager am Franklin Coonty (tre Coonty) through the County Engineer do mutually agree to cooperate in the planning, design and construction, and to share the cost and expense of the improvement as follows: THE CITY OF DUBLIN WILL: * Consent to the County road improve as per ORC 5557,02. * Proceed with plans to extend Tuttle Crossing Boulevard west to A very Road for the year 1999 construction. * Assume the lead in all public involvement. * Review and approve preliminary and final construction and right-of-way plans prior to County Commissioners public hearing. * Provide hazardous waste screening, environmental site assessment, and remediation, as necessary, at City I S expense. * Acquire any necessary additional right-of-way and easements for the ultimate six-lane road at the City's expense. * Coordinate any necessary public utility relocation or adjustments for the ultimate six-lane roadway at the City's expense. * Reimburse the County for the design and construction costs normally not installed as part of the County roadway projects, i. e., installation of new and/or replacement of existing street lights, waterlines, fire hydrants, sanitary sewers, sidewalks, bikeways, traffic signals and landscaping. * Reimburse the County for any contractor claims due to delays in right-of-way/easement acquisition and/or utility relocation. * Operate and maintain completed improvement. ~.~ . STOKES BOARD OF COUNTY COMMISSIONERS FRANKLIN COUNTY, OHIO JC:JJG:cmc c: Journal Engineer - Tuttle Road - MEMORANDUM TO: Tim Hansley, City Manager FROM: Director of Engineering/City Engineer DATE: February 21, 1997 SUBJECT: Cooperative Agreement Between Franklin County and City of Dublin concerning Improvement of Tuttle Crossing Boulevard between Old Wilcox Road and Britton Parkway Attached, please find a copy of the resolution authorizing the City Manager to sign a cooperative agreement concerning the subject matter and for approval by City Council. A copy of the cooperative agreement is also attached as Exhibit 1. In addition, attached are copies of resolutions recently approved by the Board of County Commissioners of Franklin County, Ohio, declaring the subject improvement a necessary improvement and authorizing the Engineer of Franklin County to perform surveys and investigations as may be necessary, and enter into an agreement with the City of Dublin. Franklin County will primarily be responsible for all design and construction costs. The estimated cost ofthis work is:l: $1,500,000, The City of Dublin will pay for all right-of- way/easements and other items typically not provided on County projects, i.e., sidewalks, bikepaths, traffic signals, any needed sanitary sewers, water lines, fire hydrants, etc. The costs of these items are not known at this time. This improvement is in the City's Five Year Capital Improvement Plan, and listed as the number one improvement in the Southwest Area Plan of the City of Dublin. If approved, construction may start in the year 1999. Additionally, Engineering staff is currently negotiating an agreement with the City of Columbus for extending Tuttle Crossing Boulevard to A very Road.
