Ii WHEREAS, the City of Dublin has, through a traffic study, identified that the ii intersection of A very Road and Shier Rings Road is in need of a traffic signal upgrade \ !I and additional turning lanes; and II I Ii I II WHEREAS, the City of Dublin is currently in the process of completing construction i i II plans to widen the intersection of A very Road and Shier Rings Road; and I I I I WHEREAS, the City of Dublin has designed its project to be fully compatible with the I I I City's capital improvement needs; and i I I I I , I i WHEREAS, the Franklin County Engineer is participating in the project to improve the I i I intersection of A very Road and Shier Rings Road; and I , I , I I WHEREAS, the City of Dublin will prepare construction and right-of-way plans and ! Franklin County will award and administer the construction contract and provide project I i inspection; and I i I W~E~AS, it is in t~e best interest of both governmental units to design and construct i projects III a cooperative manner; . i WHEREAS, Franklin County has passed Resolution No. _ declaring the improvement of the A very Road and Shier Rings Road intersection necessary and has authorized the County Engineer to enter into an agreement with the City of Dublin to complete the improvement; and WHEREAS, Ohio Revised Code 5557.02 requires that the consent of the City as evidenced by proper action of its legislative authority entered upon its records be first obtained before the County can proceed with the improvement. NOW, T~RE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. That it is declared to be in the public interest that consent of the City be and such consent is hereby given to the County to construct the proprosed improvement in accordance with approved plans, specifications and estimate. Section 2. The City Manager be and hereby is authorized to execute on behalf of the City of Dublin the Cooperative Agreement between Franklin County and the City of Dublin, attached hereto as Exhibit 1. Sedion 3. That the City Manager or his designee be, and hereby is, authorized to cooperate with the Franklin County Engineer as outlined in Exhibit 1 < Section 4. That this Resolution shall take effect and be in force from and after the earliest period allowed by law. WHEREAS, the intersection of A very Road and Shier Rings Road has utility to the general public of Franklin County, as well as the citizens of the City of Dublin, and WHEREAS, Franklin County has passed Resolution No. _ declaring the improvement of the Avery Road and Shier-Rings Road intersection necessary and authorizing the County Engineer to enter into any agreements with Dublin necessary to complete the improvement. WHEREAS, the intersection of A very Road and Shier Rings Road is an important intersection between the County and City highway system for through traffic, and WHEREAS, the City of Dublin is in the process of completing construction drawings, and WHEREAS, the City of Dublin has passed Resolution No.30-96, authorizing its City Manager to enter into a cooperative agreement with Franklin County for improvement of the A very Road and Shier Rings Road intersection. NOW THEREFORE, the City of Dublin (the City) through its City Manager and Franklin County (the County) through the County Engineer do mutually agree to cooperate in the planning, design and construction, and to share the cost and expense of the improvement as follows: THE CITY OF DUBLIN WILL: * Manage and direct their engineering consultant's preparation of detailed right-of- way construction plans at the City's expense. * Provide preliminary (Line, Grade and Typical) plans and final construction and right-of-way plans for the Franklin County Engineer's review and comments at the City's expense. * Assume the lead in all public involvement. * Approve final construction plans prior to County Commissioners public hearing. * Provide construction plans for replacement of County culvert just south of this improvement at the City's expense. * Provide hazardous waste screemng, environmental site assessment, and remediation, as necessary, at City's expense. * Acquire any necessary additional right-of-way and easements at the City's expense. * Coordinate any necessary public utility relocation or adjustments at the City's expense. * Pay the County $500,000.00 towards construction of the project prior to construction contract award. * Reimburse the County for any contractor claims due to delays in right-of- way/easement acquisition. * Operate and maintain completed improvement. FRANKLIN COUNTY WILL: * Review and comment on preliminary and final construction and right-of-way plans. * Franklin County Commissioner will hold a public hearing on and approve final construction plans. * Coordinate any necessary private utility relocation and/or adjustments at no cost to the City. * Obtain any necessary permits. * Prepare bid documents, advertise, take bids, award and administer the construction contract at the County's expense. * Provide for construction engineering inspection and "as built" plans at the County's expense. * Settle any contractor claims due to private utility relocation delays. * Coordinate maintenance of traffic with the City and "Paving the Way". * Pay any cost above $500,000.00 for the construction of the project in accordance with approved construction plans and specifications.
