04-96 Resolution RECORD OF RESOLUTIONS Dayton legal Blank Co., Form No. 30045 \1 Hesol,,'ioJi No. 04-96 Passed .J9. .~J-_~ ~- I , \ II A RESOLUTION OF INTENT TO APPROPRIATE A TEMPORARY I I' CONSTRUCTION EASEMENT AND A GENERAL UTILITY \ 1\ I \i EASEMENT IN A 1.000 ACRE TRACT OWNED BY LAWRENCE , " CLEMENTE AND SUSAN CLEMENTE, LOCATED ON THE SOUTH I II \ 1\ SIDE OF BRAND ROAD AND WEST SIDE OF ASHBAUGH ROAD, II IN THE CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF \ II I' OIDO, AND DECLARING AN EMERGENCY '\ \ WHEREAS, the City of Dublin has required the developer of Bristol Commons to install a , I left turn stacking lane on Brand Road as a condition of zoning; and, \ WHEREAS, said improvement will require the City of Dublin to obtain a temporary \ I \ construction easement and a general utility easement in and to the premises described in the I attached Exhibits "A" ,"B", and "C" located in the City of Dublin, Franklin County, Ohio. \ I NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin, State of I Ohio, 7 of the elected members concurring that: \ I I Section 1. Council considers it necessary and declares its intention to appropriate for the I purpose of installing a left turn stacking lane on Brand road, a temporary construction easement and a general utility easement in and to the premises located in the City of Dublin, Franklin County, Ohio, and more fully described in the legal description attached hereto as Exhibits "A" ,"B", and "C". Section 2. The City Manager is hereby authorized to cause written notice of the passage of this resolution to be served upon the owners and persons in possession or having an interest of record in the above-described property. This notice shall be served according to law. Section 3. This resolution is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The reason for such necessity is that the prompt construction of a left turn stacking lane on Brand road is necessary due to recent residential development adjacent to Brand Road, Therefore, this resolution shall go into immediate effect, \ , 1996.
