II A RESOLUTION EXEMPTING ST. PATRICK'S

i' EPISCOPAL CHURCH FROM THE CITY OF DUBLIN'S
STORMW ATER REGULATIONS
WHEREAS, the City of Dublin adopted Chapter 53 of the Dublin Code of
Ordinances entitled "Stormwater Management" on June 1, 1998; and
WHEREAS, that chapter regulates stormwater from areas of new development and
redevelopment for the purpose of protecting the public health, safety, and welfare;
and
WHEREAS, the final development plan for the land encompassing St. Patrick's
Episcopal Church was approved in 1986, at which time the City of Dublin did not
maintain a comprehensive code of stormwater regulations; and
WHEREAS, all stormwater issues were previously determined and installed as part
of the final development plan; and
WHEREAS, in reliance on that final development plan, improvements have been
undertaken and construction is ready to begin on Phase 2 of the project, which
consists of the sanctuary building; and
WHEREAS, basic fairness and equity require that the previous final development
plan approvals, and not the new stormwater regulations should control this project;
NOW, THERE~, BE IT RESOLVED, by the Council of the City of Dublin,
State of Ohio, of the elected members concurring, that:
Section 1. St. Patrick's Episcopal Church is hereby exempted from all stormwater
regulation requirements set forth in the Dublin Code of Ordinances and the final
development plan for the area shall control all stormwater issues; and
Section 2. This resolution shall take effect and be in force from and after the earliest
date provided by law,
