WHEREAS, the Dublin Community Plan (the "Plan") recommends changes to the Dublin Codified Ordinances ("Code") to manage development in accordance with the goals of the Plan; and WHEREAS, the City has been engaged in the preparation of a Unified Development Code and has not been satisfied with the results of this process; and WHEREAS, City Council has determined that major revisions to the Code regarding Planned Districts and Subdivision Regulations will benefit the community and should be accomplished in the near term; and WHEREAS, City Council has determined that an energized, straightforward and focused approach is needed for such revisions to be accomplished expeditiously; and WHEREAS, City Council has determined that a Code Revision Task Force should be established to review the Code and recommend such revisions, NOW THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, 2 of the elected members concurring, that: Sedion 1 The City's efforts to develop comprehensive revisions to the Code through the creation of a Unified Development Code shall no longer be pursued. Individual aspects of the Code, as specifically outlined in this resolution or as City council may direct in the future, shall be reviewed and recommendations made to meet the goals of the Community Plan. Sedion 2 A Code Revision Task Force (the "Task Force") of nine individuals shall be appointed by the City Council on February 3, 2003, following solicitation of interested participants. The Task Force shall be established as follows: a. The Task Force shall be comprised of two members of the City Council; two members of the Planning Commission; one individual to represent the residential development community and recommended by the Building Industry Association; one individual to represent the commercial development community; one individual to represent the Dublin Chamber of Commerce; and two City of Dublin residents serving as at large representatives. b. The first meeting of the Task Force shall be February 12,2003. All meetings of the Task Force shall be open to the public. c. The Task Force shall consider the revisions of the Planned Districts between February and June 2003. It shall submit its recommendations in ordinance form to City Council not later than June 23,2003. d. The Task Force shall meet regularly and on an energetic schedule, approximately once every three weeks to consider changes to the code regarding the Planned Districts. e. The Task Force shall consider revisions to the subdivision, and related infrastructure and development regulations in the Dublin Code of Ordinances from September 2003 to February 2004. It shall submit its recommendations in ordinance form not later than February 2,2004. The Task Force shall meet regularly and on an energetic schedule, approximately once every three weeks to consider changes to the code regarding subdivision, and related infrastructure and development regulations. g. The Task Force shall be chaired by one of its members, specifically appointed by City Council. h. The Task Force shall be technically supported by the planning staff with the assistance of the legal department. Section ') The Code Revision Task Force shall review the Dublin Code of Ordinances concerning Planned Districts, Sections 153.050 to 153.058, and shall make recommendations to the City Council on changes to those sections of the Code and any sections of the Code directly related to those sections. In reviewing these Code sections, the Task Force shall consider and make recommendations conceming the following matters: a. Simplification of and efficiency in the process necessary for the consideration of Planned Districts, to the extent compatible with city concerns regarding development; b. The appropriate level of city policy maker and staff discretion in reviewing proposed projects; c. A reduction in the number of Planned Districts in the Code; I d. Uniformity among procedures applicable to the Planned Districts. Section 4. The Code Revision Task Force shall review the Dublin Code of Ordinances concerning Subdivision Regulations, Sections 152.001 to 152.999, and shall make recommendations to the City Council on changes to those sections of the Code and any sections of the Code directly related to those sections. In reviewing these Code sections, the Task Force shall consider and make recommendations conceming the following matters: a. Identification of previously unspecified standards used by the City in development review; b. Simplification of the Code to eliminate unnecessary language or standards; c. Codification of policies consistent with desired development patterns; and d. Consistency with proposed revisions to the Code for Planned Districts. Section S The Task Force shall make a recommendation to the City Council not later than June 23,2003, regarding revisions to the Planned Districts and shall make a recommendation to the City Council not later than February 2,2004, regarding revisions to the subdivision regulations, unless a request for a time extension is approved by the City Council. Section () Following receipt of each of the recommendations of the Task Force and prior to the adoption of any recommended changes, the City Council shall refer the proposals to the Planning and Zoning Commission for its review and recommendation. In addition to the matters assigned to the Task force pursuant to this I: resolution, staff shall: ii a, Work with the Dublin Historic District interests and others in the community to prepare revisions to the code for Old Dublin, An ordinance recommending such revisions shall be presented to the City Council for initial review and first reading in April, 2003; and b. The changes between the final resolution and the one in your packet are as follows: . The second WHEREAS clause was added to acknowledge the work that has been done on the UDe. . Section 1 is new (and the other sections were re-numbered). It was added to clarify the fact that the current draft of the UDC will not be given further consideration, but that the proposed changes to the City Code as set -- forth in the rest of the Resolution will be the focus of inquiry for the Task Force. . Final section 7 is new. It was added to make it clear that the Dublin Historic District revisions and the industrial zoning matters are to be pursued by staff as discussed at the December 9, 2002 City Council meeting. There are two copies of the final Resolution attached. GUnderma{~tant Planning Director ..........1(}..(, RE: Adoption of Resolution 01-03 for Code Revision Task Force SUMMARY: At the December 9, 2002 City Council meeting, Council reviewed the staff recommendation concerning the establishment of a task force to consider changes to the City Code concerning Planned Districts and Subdivision regulations. Council directed staff to return on January 6, 2003 with a proposed resolution incorporating the matters discussed at that meeting. Two versiomof a resolution creating a Code Revision Task Force have been prepared. One version is set up for a task force of seven members and one is set for nine members. Each resolution would utilize two members of the City Council, two members of the Planning and Zoning Commission, one residential developer, one commercial developer and a representative of the Chamber of Commerce. The nine-member commission would also add two members at large also to be appointed by the City Council. Council will need to choose only one of these resolutions for action. A potential review schedule for the Planned districts would be: Wednesday, February 12; Wednesday, February 26; Wednesday, March 19; Wednesday, April 9; Wednesday, April 30; Wednesday, May 21; and Wednesday, June 11. A potential review schedule for the Subdivision districts would be: Wednesday, September 10; Wednesday, October 1; Wednesday, October 22; Wednesday, November 12; Wednesday, December 3; and Wednesday, January 7. RECOMMENDATION: Approval
