DEVELOPMENT COMMONLY KNOWN AS THE MCKITRICK PUD. WHEREAS, Cardinal Health has expressed a desire, pursuant to their growth plan and consistent with the Preliminary Development Plan for the PUD, to expand their facilities located on Emerald Parkway; and WHEREAS, the City of Dublin's economic development policy is to encourage the retention and expansion of current businesses; and WHEREAS, Cardinal Health, Inc. is a publicly traded and highly rated company which contributes significantly to Dublin's economic success; and WHEREAS, the City of Dublin desires to encourage the continued growth of Cardinal Health, Inc. in Dublin; and WHEREAS, that portion of Emerald Parkway adjacent to the McKitrick PUD has been completed and dedicated to the City, further platting within the subdivision will not be necessary; and WHEREAS, the McKitrick PUD zoning involved extensive hearings before Council and the Planning and Zoning Commission; and WHEREAS, the City of Dublin has entered into economic development agreements with Cardinal Health, Inc. which have met or exceeded the City's expectations. NOW, THEREFORE, BE IT RESOLVED by the Council, of the City of Dublin, State of Ohio, '7 of the elected members concurring that: Section 1. As to the zoning commonly known as the McKitrick PUD, Cardinal Health, Inc., shall be exempt from the applicability, if any, of Sections 153.056 (1) (8) and (J), which require that a Final Subdivision Plat be prepared and submitted for Council approval within six (6) months, and that construction be commenced within two (2) years, following approval of a Final Development Plan. Section 2. Council waives the entire Final Subdivision Plat process on Cardinal Health, Inc.'s remaining parcels of the McKitrick PUD. Section 3. This Resolution shall take effect and be in force from and after the earliest I date permitted by law. Stevens, DIrector of EconomIC Development~<}a.. c Re: Resolution 40-02 I Summary: Resolution No. 40-02 provides a waiver to Cardinal Health on the timing and platting provisions of Section 153.056(1)(8) and (1) as related to Cardinal's development known as the McKitrick PUD. Attached is a letter from Cardinal Health requesting the waiver. Due to its continued growth Cardinal has leased 60,000 square feet of additional office space in the Tuttle area to accommodate overflow staff from its headquarters building. By the end of 2002, Cardinal plans to have created 285 additional jobs in Dublin. While Cardinal is not prepared to move forward with the expansion of its headquarters at this time, it recognizes that its need for office space will continue to grow. Cardinal wants to be in a position to quickly begin construction when the time comes to expand its headquarters. In order to achieve this Cardinal would like to have a Final Development Plan that has been reviewed and approved by the Planning and Zoning Commission "on the shelf'. This waiver would create such and opportunity. Normally, this waiver would be processed through the Planning and Zoning Commission. However, since no new lot lines will be proposed and no new right-of-way or public improvements will be dedicated, there is no need for a final subdivision plat to be filed. As a result, the waiver request is being presented directly to City Council. Although Cardinal has recently occupied leased office space in the Tuttle area to accommodate overflow staff from the headquarters building, we anticipate the need for office space will continue to grow. To be prepared for the coming need for space Cardinal would like to have the Final Development Plan approved and <'on the shelf' to enable quick commencement of construction when the need for space develops. Cardinal's ability to respond quickly to the growing need for space is encumbered by certain portions of the Dublin Codified Ordinance (DCO). In order to maintain flexibility and the ability to respond in timely manner, Cardinal requests that the City of Dublin waive the requirements of DCO 153.056 (1) (8) and DCO 153.056 (J) by resolution. DCO 153.056 (I) (8) states: (8) No later than six months following approval of a final development plan bv the Plannin~ and Zoning Commission. a final subdivision plat prepared in accordance with all applicable requirements of the subdivision regulations for the area covered bv the final development plat shall be prepared for Council approval prior to appropriate recording. Such six-month period may be e>..'tended by the Commission for good cause. Cardinal Health believes that the Final Subdivision Plat process is not relevant to the remaining parcel of the McKitrick PUD. There remains nothing left to plat. Emerald Parkway and the surrounding rights-of-way and easements were conveyed to the City of Dublin previously to enable the City to construct Emerald Parkway. Cardinal Health is not anticipating the creation of new lots or actual subdivision of its land. There is nothing additional that needs to be conveyed to the City or accomplished via the platting process. Cardinal Health believes that DCa 153.056 (1) is not applicable in this particular case since this section of the DCa presupposes platting and transfer of property. However, \\~th the desire to exercise caution and to ensure full agreement and understanding betv,'een the City of r;>ublin and Cardinal that we are under no time constraint to begin construction on the remaining parcel of the McKitrick PUD, Cardinal Health requests that the City waive the requirements of DCa 153.056 (J) by resolution. We have consulted with the City of Dublin Planning Department and the Law Director prior to making this request. The guidance and support we have received from those groups has provided Cardinal with great assistance in generating this request. Assuming, in advance, that both these requests are agreeable to you Cardinal asks that these requests for waiver be placed on the agenda of the nearest possible up~oming City Council meeting.
