39-02 Resolution RECORD OF RESOLUTIONS Dayton legal Blank Co., Form No. 30045 Ii '1 Resolution No, , 39-02 Passed .. ........, YEAR -------~~ -----_._.~---- II A RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT Ii I AN APPLICATION TO THE DISTRICT 3 INTEGRATING COMMITTEE OF THE OHIO PUBLIC WORKS COMMISSION AND TO ENTER INTO AGREEMENT WITH THE OIDO PUBLIC WORKS COMMISSION FOR THE PURPOSE OF ACQUIRING GRANT FUNDS THROUGH THE STATE CAPITAL IMPROVEMENT PROGRAM/LOCAL TRANSPORTATION IMPROVEMENT PROGRAM FOR THE ARYSHIRE DRIVE CULVERT REPLACEMENT PROJECT WHEREAS, pursuant to Article VIII, Section 2k of the Ohio Constitution, the State of Ohio is authorized to issue bonds and other obligations of the State for the purpose of financing public infrastructure capital improvements of political subdivisions as designated by law; and WHEREAS, pursuant to Section 164,06 of the Ohio Revised Code, the District Three Public Works Integrating Committee has been created to accept, evaluate, and recommend applications for State financing of capital infrastructure improvement projects of political subdivisions in Franklin County; and WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Ohio Public Works Commission has been created to accept and approve applications for State financing of capital infrastructure improvement projects of political subdivisions in Franklin County; and WHEREAS, the City of Dublin has conducted a capital inventory and needs assessment and has determined that it is necessary to submit applications for financial assistance fm: capital infrastructure improvement projects; and WHEREAS, the City of Dublin wishes to apply to the District 3 Integrating Committee of the Ohio Public Works Commission for Round 17 State Capital Improvements Program (SCIP) and/or Local Transportation Improvement Program (L TIP) Grant Funds for the Aryshire Drive Culvert Replacement Project; and WHEREAS, the City of Dublin has adopted the Capital Improvements Program for 2003-2007 and has included the Aryshire Drive Culvert Replacement Project in the five-year program; NOW, T~REFORE, BE IT RESOLVED by the Council of the City of Dublin ofthe State of Ohio, of the elected members concurring that: Section 1: The City Manager is hereby authorized and directed to apply to the District Three Public Works Integrating Committee and the Ohio Public Works Commission for financial assistance for the Aryshire Drive Culvert Replacement Project; Section 2: The City Manager is further authorized and directed to enter into any agreements as may be necessary and appropriate for obtaining this financial assistance in conjunction with the recommendations of the City Engineer, and approved as to form by the City Law Director, in accordance with all authority granted to and limitations upon by the City Director of Finance; Section 3: This Resolution is for the preservation of public health, safety and welfare and i shall take effect and be in full force from the earliest time permitted by law, i Passed this / Lt-thday of .s '" f r e Ih.b ~, 2002, ~ ! Interim Director of Engineering/City Engineer ~ RE: Resolution No. 39-02 Aryshire Drive Culvert Replacement Project Ohio Public Works Commission Round 17 Grant Application SUMMARY: In the 1999 Stormwater Master Plan, the Aryshire Drive culvert replacement project was prioritized and initially scheduled for budget year 2006. Evidence of structural deterioration along with the need to provide 100-year flood protection dictated that the project be moved to budget year 2002. The project was initially included in this year's 2001 Stormwater Improvements project but was removed due to budget constraints, It is anticipated the project will be performed 2003. The District Three Public Works Integrating Committee of the Ohio Public Works Commission has available grants and/or loans for infrastructure improvements through the State Capital Improvements Program (SCIP) andlor the Local Transportation Improvement Program (L TIP). Staff is presently preparing the necessary documentation to complete the required application for the Aryshire Drive Culvert Replacement Project, Project No. 01-004-CIP. The application is due to the Mid-Ohio Regional Planning Commission (MORPC) on October 7, 2002, RECOMMENDATION: Staff is requesting Council Approval of Resolution 39-02 authorizing and directing the City Manager to apply to District 3 Public Works Integrating Committee and the Ohio Public Works Commission for financial assistance for the Aryshire Drive Culvert Replacement Project. Further, Resolution 39-02 will authorize and direct the City Manager to enter into any agreements as may be necessary and appropriate for obtaining this financial assistance should the grant receive favorable consideration.
