Ordinance No. 17 -11 Passed rT� AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION FOR THE ACQUISITION OF A 0.117 ACRES, MORE OR LESS, SANITARY SEWER EASEMENT, AND A 0.086 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM FISHEL INVESTMENTS, LLC. WHEREAS, the City of Dublin ( "City ") is preparing to extend sewer to the City's job ready site, which includes the City -owned land located at Houchard Road and State Route 161; and WHEREAS, Fishel Investments, LLC ( "Fishel ") owns a parcel that the City must acquire a sewer easement and temporary construction easement from in order to construct this sewer extension; and WHEREAS, the City and Fishel participated in discussions for the acquisition of these property interests from Fishel; and WHEREAS, the City and Fishel have come to mutually agreeable terms for the acquisition of these property interests; and WHEREAS, the City desires to execute necessary conveyance documentation to complete the transaction between Fishel and the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ------ (((((( ---- -- of the elected members concurring, that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire a 0.117 acres, more or less, sanitary sewer easement, and a 0.086 acres, more or less, temporary construction easement from Fishel, as depicted in the attached Exhibit "A ". Section 2. Fishel shall be compensated for the aforementioned property interests in the amount of Nine Thousand Forty -Five Dollars ($9,045.00). Section 3 . Haque DATE: April 7, 2011 RE: Ordinance No. 17 -11 — Land Acquisition - Cosgray /Fishel Sewer Extension Fishel Investments, LLC PROJECT BACKGROUND: The City of Dublin ( "City ") is extending sewer to the City's Job Ready Site, which includes the City -owned land located at Houchard Road and State Route 161. The City must acquire sewer easements from landowners in this area in order to successfully extend the City's sewer system. The property that is the subject of this Ordinance is owned by Fishel Investments, LLC ( "Fishel ") and is located in the unincorporated Washington Township, just outside of the City's corporation limits off the west side of Fishel Drive. ACQUISITION INTRODUCTION: City representatives successfully negotiated the acquisition of a sewer easement and temporary construction easement from Fishel for the appraised value of the property interests. These property interests are generally depicted in the map attached to this memorandum. In total, the acquisition consists of the following: Property Interest Acquiring ACRES COST 1. Sanitary Sewer Easement 0.117 $ 4,973 2. Temporary Easement 0.086 $ 42 3. Dublin Portion of Water and Sewer Tap Fees $ 3,900 4. Dublin Sewer Inspection Fee $ 130 TOTAL COST $ 9,045 ACTION TO BE AUTHORIZED BY ORDINANCE: Ordinance 17 -11 would allow the City Manager to execute all necessary conveyance documentation to formally acquire the aforementioned property interests.
