59-06 Resolution RECORD OF RESOLUTIONS Dayton _~~_El!I3_I~_n_~,__!~~_:J_?_r!1l No. 30045 Resolution No. 59-06 Passed .20_ -- - - --------------------------------- - - - -------- -------- A RESOLUTION ACCEPTING THE LOWEST AND BEST BID FOR THE EMERALD PARKWAY, PHASE 5B PROJECT, AND APPROPRIATING FUNDS THEREFOR WHEREAS, formal advertising and competitive bidding procedures have been conducted, pursuant to Section 8.04 of the Dublin Charter and Chapter 37 of the Dublin Code, for the Emerald Parkway, Phase 5B project; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above-referenced project as a "single source" procurement, for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities; and WHEREAS, Council has determined that the bid submitted by McDaniel's Construction Corporation, Inc. constitutes the lowest and best bid for the project; and WHEREAS, it is necessary to amend the annual appropriations ordinance to provide the necessary funding authorization for the project. NOW, THE~, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the bid submitted by McDaniel's Construction Corporation, Inc. in the total amount of$I,192,897.78 is hereby accepted. Section 2. That the City Manager is hereby authorized to enter into contracts with McDaniel's Construction Corporation, Inc. for performance and completion of the Emerald Parkway, Phase 5B project, pursuant to the Advertisement, Proposal and Contract Documents for said project on file in the office ofthe City Engineer. Section 3. That there be appropriated from the unappropriated balance in the McKitrick TIF Fund the amount of $700,000 to account 421-0314-810-2790 for the purpose of transferring funds to the Emerald Parkway Phase 5 TIP Fund. Section 4. That there be appropriated from the unappropriated balance in the Emerald Parkway Phase 5 TIP Fund the amount of $1,252,500 to account 440-0314-780-2551 for the project. Section 5. Brautigam, City ManagerU~ 5. 0~ Date: June 28, 2006 -- Initiated By: Paul A Hammersmith, P.E., Director of Engineering/City Engineer Ken Richardson, P.E., Assistant City Engineer - Design Re: Resolution No. 59-06 - Emerald Parkway, Phase 5B Bid Acceptance Summary: On May 31, 2006, six (6) bids were received, publicly opened and read for the Emerald Parkway, Phase 5B project. McDaniel's Construction Corporation, Inc. $1,192,897.78 George J. Igel & Company $1,250,798.90 Complete General Construction Company $1,281,297.40 Strawser Paving Company $1,338,916.25 Decker Construction Company $1,350,716.53 Trucco Construction Company $1,367,189.68 The Engineer's estimate was $1,400,000. The legislation that authorized the establishment of the McKitrick TIF district was amended in 2003. The amended legislation provided for the addition of Emerald Parkway from Sawmill Road to Riverside Drive in the Description of Public Infrastructure Improvements to be funded by service payments generated from the TIF district. This ordinance provides for a transfer of $700,000 from the McKitrick TIF Fund, utilizing existing reserves in that Fund, to the Emerald Parkway Phase 5 TIP Fund. The transfer amount and the existing fund balance in the Emerald Parkway Phase 5 TIF Fund will provide sufficient resources for the project. The appropriation request for the Emerald Parkway Phase 5 TIP Fund is based on the bid amount and a five percent estimate for contingencies. McDaniel's Construction Corporation, Inc. submitted the lowest and best bid, which includes: 1,500 feet of four-lane boulevard, street lights, and median break access for Life Time Fitness. Construction ends north of Billingsley Ditch. Landscaping is not included with this project. For Council's reference and review, a reduced set of project construction drawings has been placed in the Council planning room. Resolution 59-06 June 28, 2006 Page 2 Staff has thoroughly reviewed the McDaniel's Construction Corporation, Inc. bid. Previous experience with McDaniel's Construction Corporation, Inc. has been favorable, including these recent projects: Avery RoadlBrand Road intersection improvements and turn lanes on Hyland Croy Road for the Tartan West Development. Recommendation: Staff recommends approval of Resolution 59-06 accepting the bid of McDaniel's Construction Corporation, Inc. in the amount of $1,192,897.78 and authorizing the City Manager to enter into a contract with McDaniel's Construction Corporation, Inc. for this project.
