19-06 Resolution RECORD OF RESOLUTIONS Dayton Legal ~I_an~, Inc" ForrTl_!'lSl.:.. ~QO~5 Resolution No. 19-06 ,20_ A RESOLUTION WAIVING COMPETITIVE BIDDING REQUIREMENTS, PURSUANT TO SECTION 8.04 ('CONTRACTING PROCEDURES'), PARAGRAPH (C) ("WAIVER OF COMPETITIVE BIDDING") FOR THE 2006 EMERALD FIELDS RESTROOM PROJECT WHEREAS, Section 8.04(c) of the Revised Dublin Charter authorizes City Council, by a vote of no less than five (5) members, to waive competitive bidding requirements if Council determines that it is in the best interest of the City to do so; and WHEREAS, a competitive bidding process for the Emerald Fields Restroom Project was undertaken and the single bid received on January 17, 2006 was rejected, as the bid exceeded the estimate of $ 213,000 for the project; and WHEREAS, staff subsequently solicited proposals for the project and received three proposals, including a proposal from Ultimax, Inc, in the amount of $231,595,00, which staff believes is fair and reflective of the value of this construction; and WHEREAS, Council has determined that it is therefore in the best interest of the City not to undertake an additional competitive bidding process for the Emerald Fields Restroom Project. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, -Ii.- of the elected members concurring: Section 1. That competitive bidding requirements are hereby waived for the construction of the Emerald Fields Restroom Project. Section 2. Brautigam, City Manag~6 .~0~~ DATE: March 2, 2006 INITIATED BY: Fred Hahn, Director of Parks & Open Space RE: Resolution No. 19-06, Waiving Competitive Bidding for the Emerald Fields Restroom Project (Northeast Park Restroom) Summary On Tuesday, January 17, 2006 bids were opened for a restroom to be constructed in Emerald Fields. One bid was received from U1timax, Inc, in the amount of $380,790. The estimate for this project was $213,000. This bid was rejected. Staff believed the estimate was in line with the market value of the project and contacted several construction companies including Ultimax, Inc. requesting proposals on the project without any changes to the plans, Three (3) proposals were received. Base Bid 1) Nadalin Company Inc. $289,000 2) Concept Builders Inc.. $296,882 3) Ultimax, Inc. $231,595 These prices reflect a substantial reduction in the original bid price with Ultimax Inc. being the lowest. Staffbelieves Ultimax's proposal is fair and reflective ofthe value of this construction. The funds for this project were anticipated in the 2006 Capital Improvement Program in the amount of $280,000, of which $40,000 will be needed for the sewer and water tap fees associated with this project. This project consists of construction of a restroom and associated site amenities. Complete construction details are available for review in the Council Planning room, Recommendation Staff is recommending waiving of formal competitive bidding and awarding contract for the Northeast Restroom Project to Ultimax, Inc. in the amount of$231,595. This is based upon the project being initially advertised with only one bid received and due to this bid being higher than the budget and market value. Proposal subsequently received from Ultimax, Inc. was in line with the budget and reflective of market value. Staffhas completed references on Ultimax, Inc. and found their references to be satisfactory. Dublin City Council has the right to waive competitive bidding by a vote of no less than five members if it is determined that by doing so it is in the best interest of the City.
