21-69 Ordinance I I ORDINANCE NO. '2. \ - () l , VILLAGE OF DUBUN, OHIO AN ORDINANCE PROVIDING FOR A CHANGE IN ZONING OF CERTAIN REAL ESTATE FROM AGRI- CULTURA LAND RESIDENTIA L TO COMMERCIA L DISTRICT C WHEREAS, on 5~.~\ \,j , 1969, a request was made in writing to Village Council to rezone the real estate hereinafter described from Agricultural and Residential to Commercial District C; and WHEREAS, on <"~ ---. - I S- , 1969, the proposal was J t:.,P \ submitted to the Planning Commission of the Village of Dublin, Ohio, for approval, disapproval or recomme ndation; and WHEREAS, on the r" ,-' '"} , 1969, the said Planning '---J C , Commission reported to the Village Council that it h ~ ~ \:.':;Z { II the aforesaid change in zoning; and WHEREAS, on \,~(\ ~ , 1969, the contents of this Ordinance, together with the report of said Planning Commission, was filed for public inspection in the office of the Village Clerk where it has remained, I and WHEREAS, on 0C~ ), <:) , 1969, Council set the matter down for a public hearing to be held on '\)F"C, l , 1969, at 8 p. M. as req uired by law; and WHEREAS, on "0' C \ , 1969 after due notice, said \7.. - public hearing was held. NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, S of the elected members concurrin : SECTION 1. That the following described real estate situated in the Village of Dublin, Ohio, shall be and it hereby is rezoned from Agricultur 1 and Residential to Commercial District C, and made part of Commercial District C of the Village of Dublin, Ohio, and shall be subject to the regu- lations as set forth in Ordinance No.3-54 as amended by Ordinance No. 07- 67 of the Village of Dublin, Ohio, pertaining to Commercial District C: Situate in the State of Ohio, County of Franklin and the Village of Dublin and being part of a certain 20.68 Acre Tract, same being the remainder of a certain 50 acre tract conveyed to John 1. Thomas, by deed recorded in Deed Book 1535. page 238, records of the Recorder's Office, Franklin County, Ohio, and being more particularly described as follows: Beginning at a spike in the center line of Tuller Road at the southeast corner of said John I. Thomas, same being the southwest corner of a certain 3.0 Acre Tract, as conveyed to Earl C. Headlee and Bertha May Headlee, by deed recorded in Deed Book 1369, Page 398. records of the Franklin County Recorder's Office; thence N. 86 deg. 38' 29" W.. with the center line of Tuller Road. a distance of 250.00 ft. to a spike; thence N. 2 deg. 32' 31" E.. passing an iron pin at 25.00 ft.. a distance of 528.05 ft. to a point in the southerly , boundary line of a certain 18.04 Acre Tract, conveyed I to the State of Ohio, as recorded in Deed Book 2665, Page I 559, records of the Recorder's Office, Franklin County, Ohio. same being the right of way for Interstate Route No. 270; ! thence Easterly with said south right of way of Inter- state Route No. 270 and a curve to the right, having a radius of 12,117.67 ft., a central angle of 1 deg. 10' 58" ~ and a chord bearing S. 89 deg. 33' 04" E.. a distance of j 250.16 ft. to an iron pin in the east line of said Thomas; l i thence S. 2 deg. 32' 31" W., with the east line of said 1 I Thomas and the west line of said Headlee and passing an ! ~ iron pin at 515.75 ft., a distance of 540.75 ft. to the ! point of beginning, containing 3.064 acres. more or less, and subject to all legal highways. ! SECTION 2. That this Ordinance shall take effect and be in , force from and after the earliest period allowed by law.
