17-68 Ordinance , ORDINANCE NO. 1 7 - 6 8 VILLAGE OF DUBLIN, OHIO AN ORDINANCE PROHIBITING ABANDONMENT OF VEHICLES: RESTRICTING DISPOSITION OR KEEPING OF WRECKED. NON- OPERATING OR DISCARDED VEHICLES ON STREETS OR PRIVATE PROPERTY PROVIDING FOR IMPOUNDING OF CERTAIN VEHICLES: AND IMPOSING PENALTIES. WHEREAS, in the Village of Dublin vehicles are or may in the future be abandoned in the streets or other places within the Village; and WHEREAS, there are or may in the future be dismantled, partially dis- mantled, wrecked, junked, non-operating or discarded vehicles left about the Village other than in junk yards or other appropriate places; and WHEREAS, such conditions tend to impede traffic in the streets or interfere with the enjoyment of or reduce the value of private property; invite plundering; create fire hazards and other safety and health hazards to children as well as adults; interfere with the comfort and well-being of the public; and create, extend, and aggravate blighted conditions; and WHEREAS, adequate protection of the public health, safety and welfare requires that such conditions be regulated, abated or prohibited; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF DUBLIN, STATE OF OHIO, 0, of the elected members concurring: SECTION 1. That it is hereby declared to be and is a nuisance for any person within the meaning of this Ordinance to harbor and keep outs ide of a building or buildings, a motor ve hicle or ve hicles "" in a dil,apidated condition as hereinafter defined which encourages and creates hazardous conditions. SECTION 2, The following definitions shall apply in the interpre- tation and enforcement of this ordinance: 1. "Person" shall mean any person, firm, partnership, association, corporation, company, or organization of any kind, 2, "Vehicle" shall mean a machine propelled by power other than human power des igned to travel along the ground by use of wheels or treads, and transport persons or property or pull machinery and shall include, without limitation, auto- mobiles, trucks, trailers, buses, motorcycles, and tractors. 3, "Street or highway" s hall mean the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. 4. "Property" shall mean any real property within the Village which is not a street or highway. " . SECTION 3. No person shall leave any vehicle on any street, or highway within the Village for more than 24 hours without first obtaining the consent of the mayor. SECTION 4. No person in charge or control of any property within the Village of Dublin, whether as owner, tenant. occupant, lessee. or otherwise, shall allow any partially dismantled. non -operating. wrecked. junked. or abandoned vehicle to remain on such property longer than twenty-one (21) days after the receipt of written notice from the Chief of Police. or any member of his department designated by him. to remove said vehicle from such property; except that this section shall not apply with regard to a vehicle in an enclosed building. SECTION 5. The Chief of Police or any member of his department designated by him is hereby authorized to remove or have removed any vehicle left at any place within the Village which is in violation of this Ordinance. and to order such vehicle into storage at a place to be designated by the major, where such vehicle shall remain until law- fully claimed or disposed of in accordance with Chapter 737 of the Ohio Revised Code, SECTION 6, Whoever violates the provisions of this Ordinance shall be fined not more than Fifty ($50,00) Dollars. and shall pay the cost of the prosecution. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable under this Ordinance. SECTION 7. That this Ordinance be and the same hereby is declared to be an emergency measure necessary for the immediate preservation of the public safety. peace and general welfare becaus e the conditions with which this ordinance deals presently exist within the Village and pose an immediate threat of fire and of injury to children. and that this Ordinance shall take effect immediately upon its passage.
