ACCEPTING PETITION FOR ANNEXATION OF TERRITORY
BE IT ORDAINED by the Council of the Village of Dublin, .5- mem-

THAT the petition of Marjorie Armstrong, et aI, for the annexation of
the following described territory in the County of Franklin and adjacent to the
Village of Dublin, to-wit:
Situate in the Township of Washington, County of Franklin, State of
Ohio, being part of Virginia Military Survey Nos, 2542 and 2999, and being
more particularly described as follows:
Beginning at an angle point in the existing Dublin Corporation Line as
the same was established and as shown of record in Miscellaneous Volume 139,
Page 282, Recorder's Office, Franklin County, Ohio, said angle point being in
the existing southeast property corner of a 3,59 acre tract of land (original
23,89 acre tract) presently owned by Joe Brown & Mary E. Baily, Trustees,
as the same is shown of record in Deed Book 1286, Page 518, Recorder's
Office, Franklin County, Ohio;

Corporation Line, a distance of approximately 1,750 feet to a point in the
existing centerline of the South Fork of Indian Run;

said South Fork of Indian Run and the meanders thereof, a distance of approxi-
mately 332 feet to a point in the existing northwest property corner of a .1:,62.
acre tract of land (original 2,00 acre tract) presently owned by Gaily E. Smith
(L. E,) as the same is shown of record in Deed Book 2278, Page 663, Recorder's
Office, Franklin County, Ohio;
Thence Southwesterly, along and with the existing west property line
of the said Smith 1,62 acre tract, the same being in part the existing east
right-of-way line of a twenty (20) foot Private Road and Southwesterly, along
and with said lines produced southwesterly across Post Road (60 feet in width),
a distance of approximately 378 feet to a point in the existing south right-of-way
line of the said Post Road, said point being thirty (30) feet south from (as
measured at right angles) the existing centerline of the said Post Road;
Thence Northwesterly, along and with the existing south right-of-way
C line of the said Post Road, the same being thirty (30) feet south from and running
parallel to the existing centerline of the said Post Road, a distance of approxi-

Council of said Village, be and the same hereby is accepted,
This Ordinance shall take effect and be in force immediately and is
declared to be an emergency measure for the protection of the public health,
and general welfare of the Village of Dublin.

The Commissioners of Franklin County, State of Ohio, proceeding this
day to render their decision on the petition of Emerson E. Armstrong, et al.,
filed December 2, 1965, and having in open hearing heard all of the persons
desiring to be heard for or against the granting of said petition, and having
considered all the facts with reference thereto, and being fully advised,
FINDS, That said petition contains all of the matters required by law;
that the territory sought to be annexed is adjacent and contiguous to the
said Village of Dublin, Ohio; that the petition contains a full and complete
description of said territory sought to be annexed; that the map for said
territory attached to the said petition is accurate; that said petition is
signed by a majority of the adult freeholders residing on the teDitory
C sought to be annexed; that the required legal notice of the petition has
been published and posted as required by law; that the territory to be
annexed is not too large nor too small; that it is just, right, and proper
that said petition should be granted; therefore,
IT IS HEREBY ORDERED on motion of Mr. Myers, seconded by Mr. Southwick
that the prayer of said petition be granted and that the territory described
in said petition be annexed to the Village of Dublin, Ohio, in accordance
with the law; that the orders and proceedings of this Board relating to said

Dear Sir:
Enclosed please f:f.nd a copy of the resolution adopted by the Board of County
Commissioners of Franklin County, Ohio, on December 7, 1965, relative to
the annexation of territory described in a petition filed by you, as agent,
to the Village of Dublin, Ohio, which resolution sets forth the time and
place for bearing on the petition.
~ In accordance with the provisions of Section 707.05 of the Revised Code of
Ohio, it 18 necessary that you cause a notice containing the substance of
the petition, and the time and place where it will be heard to be published
for a period of six consecutive weeks, prior to the hearing, in a newspaper
pr~n.t.e" and of general circulation :f.n the County. A copy of the notice is to
be posted 1n a conspicuous place within the limits of the territory proposed
to be annexed not less than six weeks prior to the time fixed for hearing.
At the time of the hear:f.ng, the Board should be furnished a Proof of Publication
together with an affidavit (both in duplicate) stating that the notice baa been
posted for the required time in a conspicuous place within the territory.
In addition, the person or persons circulat:f.ng the petition must file a separate

Dear Mr. Myers:
As a property owner adjacent to the land area now being considered for
annexation to Dublin I would like to present my views for your consideration.
Until a little over a year ago I resided at 6252 Avery Road. I am the owner
of the 38 acres at this address. It lies at the southwest corner of the in-
tersection of Avery Roaa and U.S. 33 in Washington Township. My older son,
~ Nonnan and his wife now reside there. I have been on a leave of absence for
the past year from my position of psychologist with the State of Ohio because
of a health condition. It is entirely possible that I would return to Ohio
with sufficient improvement in my health.
As you no doubt are aware the area west of Dublin is quite scenic. It
is still essentially rural - one of the few remaining in Franklin County. I
have had any mDllber of people comment on how they enjoy driving out in this
area on U.s. 33 because of its natural beauty.
For the most part this seems to me to be prime area for residential
development - one of the relatively few remaining areas unspoiled by lack of
mature community planning and foresight.
You are well aware I am sure that development of communities has all
too often in the past been characterized by expedient considerations - the

result of pressure groups with vested interests. The consequence is poorly

I planned communities resulting in conditions not conducive to healthful and
beneficial living and good human relationships. In my professional judgment

this has a decided impact on the most basic social structure - the family. We
0 reap the harvest in instable families, delinquency, etc.
There is a very real question in my mind wheth~r the annexation move under
consideration is another instance of expediency rather than considered and mature
thinking in respect to the long-term con~equences. I am stating this frorn a life-
time background of studying and applying the social sciences in matters of human
behavior and living conditions. It is my thinking that the annexation of this
property to Dublin with the ensuing developments which are apparently anticipated,
namely industrial development, would not be in the best interests 'of the community
at large. It would seem that the consensus of the comnnmity at large has been
expressed in the results of the May 3rd.election.inPrecinct B and a preceding
, ,
election in Precinct A, the latter prohibiting the rezoning of any part of Pre-
cinct A for any kind of commercial development. In my judgment the annexation
~ move is a short sighted view, of the problems involved. To me there appear to be
other solutions of,the problems involved which ,would be superior from a stand-
point of the overall effects on the community at.large. I t wou~d seem that any
citizen and property owner should be able to speak on this at a public meeting of
the citizens of Precinct A in Washington Township. .
I consider my property very strategically located for commercial develop-
ment. Conceivably my property would be worth considerably more if developed
camnercially. For instance- the 'State Highway'plans to put an interchange frorn
Avery Road and U. S. 33 on my property, which it would seem to me would make it
a prime site for commercial development but I am convinced that this would not
be in the best interests of the connnunity at large. r wish to thank you for this
opportunity to express my thinking on this matter and I believe that there is just
~ cause for the majority of opinion as expressed in the recent elections.

Gentlemen:
I" as a resident and voter of Washington Township" am opposed to the
pending annexation of a part of Precinct "B" by the Village of Dublin.
I presently reside across from" and adjacent to" the subject part
[ of Precinct "B" to be annexed.
In the election of May 3" 1966" the voters of Precinct "B" rejected the
amendment to rezone the subject area to light manufacturing. It is
my belief that this present annexation is but a subterfuge to enable
proponents of the zoning change to circumvent the expressed will of
the people. I think this was clearly reflected in the recent election.
Only a few will benefit from this annexation and a great many will be
injured. It is my belief that this purpose is not sufficient to justify
annexation.
I am sure you will consider these facts when you deliberate this
matter and reject this annexation.

Mr. Sou~hwick offered the following resolution and moved the adoption of
the same, which was duly seconded by Mr. Koontz:
BE IT RESOLVED, By the Board of County Commissioners of Franklin County,
Ohio, that the petition for annexation of certain adjacent territory to the
Village of Dublin, Ohio, signed by Emerson E. Armstrong, et a1., and appointing
John J. Chester as agent for said petitioners; said territory being described
as follows:
Situate in the Township of Washington, County of Franklin, State of Ohio,
being part of Virginia Military Survey Nos. 2542 and 2999, and being
more particularly described as follows:
Beginning at an angle point in the existing Dublin Corporation Line as
the same was established and as shown of record in Miscellaneous Volume
139, Page 282, Recorder's Office, Franklin County, Ohio, said angle
point being in the existing southeast property corner of a 3.59 acre
tract of land (original 23.89 acre tract) presently owned by Joe Brown
& Mary E. Baily, Trustees, as the same is shown of record in Deed Book

Corporation Line, a distance of approximately 1,750 feet to a point in
the existing centerline of the South Fork of Indian Run;
Thence Northwesterly, along and with the existing centerline of the said
South Fork of Indian Run and the meanders thereof, a distance of approxi-
mately 332 feet to a point in the existing northwest property corner of
a 1.62 acre tract of land (original 2.00 acre tract) presently owned by
Gaily E. Smith (L.E.) as the same is shown of record in Deed Book 2278,
Page 663, Recorder's Office, Franklin County, Ohio;
Thence Southwesterly, along and with the existing west property line of
the said Smith 1.62 acre tract, the same being in part the existing east
right-of-way line of a twenty (20) foot Private Road and Southwesterly,
along and with said lines produced southwesterly, across Post Road (60
feet in width), a distance of approximately 378 feet to a point in the
existing south right-of-way line of the said Post Road, said point being
thirty (30) feet south from (as measured at right angles) the existing
centerline of the said Post Road;

of the adult resident freeholders of a certain area as hereinafter described in
Washington Township which is contiguous and adjacent to the Village of Dublin
and pray that the described territory be annexed to the Village of Dublin, Ohio, I
according to the statutes of Ohio. Said area sought to be annexed is situated in
the State of Ohio, in the County of Franklin and Township of Washington and
bounded and described on the attached description incorporated herein and
made a part hereof by reference.

Situate in the Township of Washington, County of Franklin,
State of Ohio, being part of Virginia Military Survey Nos. 2542
and 2999, and being more particularly described as follows:
Beginning at an angle point in the existing Dublin Corporation

Thence Northerly, along and with (in part) the said existing
Dublin Corporation Line, a distance of approximately 1,750 feet to f:'
