093-78 Ordinance - - - ---- - - ----- - - I" ~ -- I rd.~ NOV 6 1978 I I AN ORDINANCE AUTHORIZING THE MAYOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT FOR APPRAISAL SERVICES, AND DECLARING AN I EMERGENCY ("'\ IT IS HE~BY ORDAINED by the Council of the Village of Dublin, Ohio, of the members concurring, that: \ ,., SECTION 1. The Mayor and Clerk-Treasurer are hereby authorized and directed to sign, on behalf of the Village of Dublin, Ohio, and deliver a certain contract between the Village of Dublin, Ohi and Paul Askins, Realtor-Appraiser, a copy of which is attached hereto and made a part hereof. SECTION 2. This Ordinance is hereby declared to be an emergency measure necessary for the protection of the health, safety and welfare of the residents of the Village of Dublin, Ohio for the reason that appraisals of the easements the Village is required to obtain must be made so that the construction of the proposed David Road Water Delivery System can proceed on schedule, and, therefore, this Ordinance will take effect and be in force from I and after the earliest period allowed by law. I I \.) RECITALS I Village of Dublin is proceeding with construction of a water system commonly referred to as David Road Water Line. The ob- taining of easements across private lands is necessary for com- pletion of the project. Appraisal of the fair market value of I the easement rights across such private lands is a prerequisite to the obtaining of such easements. I I I Village of Dublin and Appraiser have agreed that Appraiser will make appraisements, in accordance with this contract, of fair market value of the various easements required to be obtaine Accordingly, the parties have agreed as follows: APPRAISER AGREES: 1. Prior to making contact with any land owner, he will make a physical inspection of the entire water route in company with a representative of the Village of Dublin or with a representative of the Consulting Engineer for I the Village of Dublin, I n 2. Communicate with each affected property owner, or his representative, for the purpose of giving to that owner, ~ I or his representative, the opportunity to accompany the ~ Appraiser during his inspection of the property for appraisal purposes, I 3. Appraiser will make not less than one on-site inspection of each parcel, in addition to the inspection of the entire route, as recited in paragraph 1. 4. After completion of each appraisal, Appraiser will de- ~ liver to the office of the Village of Dublin: I A. A completed Report of Appraisement, in form as I attached hereto. I B. A description of easement. C. A map of the easement. I D. Deed History covering not less than the previous I I 10 years. I 5. Appraiser will be available, at all reasonable times, I with Village of Dublin, or their representatives, to I I consult on all matters relating to the sewer easement I appraisals. I 6. Appraiser will furnish all appraisal forms for each (' I I , parcel, the legal work necessary to compile deed his tor \.J I covering not less than the previous 10-year period, and water easement purchase agreements (an attachment to the Deed of Easement). To be given to each free holder at time of appraisal. 7. Appraiser will commence his work upon request from the Village of Dublin, provided Appraiser has been furnishe with legal data described in paragraph eight (8) below for the parcels to be appraised. VILLAGE OF DUBLIN AGREE: I 8. Village of Dublin will furnish to Appraiser, for each ----- - ---- ------ --- - .... . . parcel to be appraised, name(s) of owner(s), legal description of easement with computation of square foot- I age within the easement, detailed scale map of easement I and a complete set of Engineering drawings covering the entire water project. I MUTUAL AGREE}lliNTS: 9. The fee to be paid by Village of Dublin to Appraiser r-..... for each report of Appraisement is $400.00, I 10. Village of Dublin will cause payment to be made to W Appraiser within 30 days after presentation of a billing for fees. I II. The services of Appraiser contemplated under the terms of this contract do not 'include appearance in court upon any contested matter. I 12.
