AN ORDINANCE' AUTHORIZING AND DIRECTING
THE VILLAGE ADMINISTRATOR TO ADVERTISE
\ FOR BIDS FOR GARBAGE AND RUBBISH COL~
LECT I NG AND HAIJ 1I NG SERV I CE TO THE
"- VILLAGE: AND DECLARING AN EMERGENCY.
WHEREAS, the present contract for garbage and rubbish collecting
and hauling for the Village expires June 30, 1978; and
WHEREAS, there is need for a contract for said services subsequen1
to said date:
NOW, THEREFORE, BE IT ORDAINED, by the Council of ' the Village of
Dublin, State of Ohio, ~ of the elected members concurring:
SECTION I . That the Village Administrator be, and he hereby is,
authorized and directed to advertise for bids for garbage and
rubbish collecting and hauling service to the Village of Dublin,
Ohio, for the per i od commenc i ng :.Jul y, I., '. 197~ and~end i'ng September
30, 1979, according to the following contract specifications:
Garbage and rubbish to be collected from all residences in the
Village of Dublin, Ohio, on the same specified day of each wee~.
If a legal holiday falls on said specified day, then the garbage
.- and rubbish collection may be made on the next day of that week.
J The term rubbish shall include all' household trash, refuse and
I i other waste matter such as bottles, tin cans, food, food contain-
-- cinders, tree and hedge clippings, grass trimmings,
ers, ashes,
leaves and other waste: mater-ia I' accumulating abou~ residential
property. The term rubbish, does not include waste material accum-
ulated in the construction, remodeling or repair of buildings. , ,
The Contractor shall bid both to remove said garbage and rubbish
from where Contractor can back truck to within five (5) feet of
the containers, and an alternate bid for collection of said gar~':
bage and rubbish by the Contractor assuming said garbage and rub-
bish is placed within ten (10) feet of a public street by the
householder. The householders garbage and trash containers shall
be twenty (20) or thirty (30) gallons, and' shall not exceed one
hundred twenty (120) gallons per nesidence per week. Cans must
have tight fitting lids and handles. Plastic bags must be tied.
Contractor is to replace lids on containers. Business trash is
not,to be included i~,normal household trash. Any tree or hedge
clippings shall be tied in bundles not over four feet (4') long
by property owner or placed in plastic bags. Contractor is not
required to pick up more than two (2) thir~y (30) gallon plastic
bags of trimmings or two bundles of such trimmings per home pe~
week. Contractor shall remove weekly all refuse and trash in
U Village owned trash cans, not to exceed twelve (12) in number.
Contractor must have closed packer type truck to pick up rubbish
and garba~)e.
The relationship between the Village of Dublin and the contractin~
party shall be solely contractual and the contractor shall furnis~
all equipment and labor for all services to be performed. Con-
tractor shall carry industrial compensation insurance of, the State
of Ohio and pay all lawful payroll deduction and unemployment com-
pernsation payments due any governmental agency.

U Contractor sha II be responsible for any negligence of the con-
tractor or any of contractor's agents, officers or employees.
All equipment, including trucks and automobiles, bu t not limited
thereto, used in said garbage and trash collection shall be pro-
tected by public liability and property damage insurance i n the
amount of at least $250,000.00 to protect' the Village of Dublin,
Ohio, and its i nhab i tants, and to save the same harmless from
and against any and all negligent acts ,of contractor, his agents
or employees.
Bids shall speciify a lump sum price for each month during the con
tinuance of the contract for garbage and rubbish collectiQ~and
hauling service for all of the existing residences in the V i II age
of Dublin at this time, and bids shall also specify an additional
price for each additional residence built and occupied or annexed
to the Village after the awarding of this contract and said Bid
sha II be on a monthly basis for each such additional residence.
The contract price may be modified according to law during the -4:
term of this contract to compensate for increased cost of disposa .
The contractor shall be paid on or before the 10th day of each
month. Said contract to be cancellable by the Village of Dublin,
without liability, upon thirty days written notice of cancel'atior
r to the contractor.
, All bids shall be sealed and shall be filed with the Village Ad-

ministrator of the Village of Dublin, Ohio, before 12:00 Noon____
.:LN~ '1 , 191!, at which time said bids shall be opened.
A II bids sha II be accompanied by a bond or certified check in the
amount of $100.00. The Counc i I of the Village of Dublin reserves
the right to reject any and all bids.
SECTION 2. That this Ordinance be, and the same hereby is, de-
clared to be an emergency measure nec~ssary for the immediate
preservation of the public health and safety and for the reason
that garbage and rubbish collection is presently needed to proteci
the health and safety of the residents of the Village, and that
this Ordinance shall take effect and be in force immediately upon
its passage.
